WHEREAS, on 14th June 2022, the Plaintiff actioned the Defendant for the sum of £2,700.00 in respect of the Defendant's share of the costs of road-resurfacing works carried out in 2021;

(2) on 7th July 2022, the Defendant having contested the claim, the Court sent the proceedings to proof;

(3) on 1st February 2023, the Defendant having failed to file an amended Answer as directed by the Court on 4th January 2023, the Plaintiff made an application for judgment in default under Rule 32(13) of the Petty Debts Court Rules 2018 and the Defendant applied for an extension of time;

(4) on 6th February 2023, the Court gave notice that it rejected the Defendant's application and gave judgment to the Plaintiff.

NOW TODAY, having heard from the Plaintiff through its representatives and the Defendant personally, the Court ORDERED the Defendant to pay to the Plaintiff:

a) the sum of £2,700.00;

b) statutory interest on any outstanding balance in accordance with Practice Direction PD 05/3 from 6th February 2023 to the date of payment;

c) the sum of £570.00 representing the fixed costs in accordance with Practice Direction PD 18/01;

d) interest on such costs in accordance with Practice Direction PD 05/4 from today to the date of payment;

and AUTHORISED the Plaintiff to have:

a) the personal property of the Defendant arrested and sold, providing that no sale shall take place without the Court's permission, unless the Viscount is satisfied that the Defendant is aware that the goods have been arrested;

b) the wages of the Defendant arrested at the standard rate of £80.00 per week.
