WHEREAS (1) on 12th October 2018, in the Royal Court of Jersey (Family Division), in proceedings between Pedro Henrique Sanches Gouveia (the "Defendant") c/o Premier Waste Management Limited, St. Brelade's Depot, La Rue Carré, St. Brelade OF THE ONE PART, and Regina Santiago Do Rosario (the "Plaintiff") OF THE OTHER PART, the Court ordered THAT the Defendant pay maintenance at the rate of £53.50 per week in respect of Natalie Gouveia, born on the 15th February 2017, the child of the parties, as from 1st October 2018; and

(2) on 23rd June 2021, the Defendant was summonsed to appear in the Petty Debts Court on the 7th July 2021 to show cause why, pursuant to the said Order of the Royal Court, he should not be ordered to pay:

a) arrears of maintenance in the sum of £6,099.00 for the period from 15th March 2019 to 26th May 2021 inclusive, namely 114 weeks child maintenance;

b) the costs of and incidental to the action on a full indemnity basis; and

furthermore the Defendant to show cause why:

c) a wage arrest should not be made against him in the sum of £80.00 per week from this day comprising:

i. £26.50 per week in respect of the arrears of maintenance until the date of payment in full; and

ii. £53.50 per week for ongoing maintenance for the said child, this pursuant to the said Order of the Royal Court and in accordance with Article 2 of the Maintenance Orders (Enforcement)(Jersey) Law 1999, such sum to be increased each year on the 12th October in accordance with any increase in the Jersey Retail Prices Index.

NOW TODAY, the Defendant not having appeared the Court condemned the Defendant to pay to the Plaintiff:

1) arrears of maintenance in the sum of £6,099.00, for the period from 15th March 2019 to 26th May 2021 inclusive, pursuant to the said Order of the Royal Court;

2) interest thereon at the appropriate daily rate on any outstanding balance in accordance with Practice Direction PD 05/3 from this day to the date of payment.

3) The fixed costs of the action in accordance with Practice Direction PD 18/01; and

4) interest on such costs from this day to the date of payment in accordance with Practice Direction PD 05/4, and

PERMISSION is hereby granted to the Plaintiff:

1) to cause the personal property of the Defendant to be arrested and sold, providing that no sale of movables on which a distraint has been made shall take place without the leave of the Court unless the Viscount is satisfied that the Defendant is aware of the making of the distraint, and

2) authority is given to arrest the wages of the Defendant to the extent of:

a) £53.50 per week in respect of ongoing child maintenance, such sum to be increased each year on the 12th October in accordance with any increase in the Jersey Retail Prices Index or such other costs of living index as may supersede it in the preceding twelve months; and

b) £26.50 per week in respect of the arrears of child maintenance until the date of payment in full.
