Application for amendments of the Constitution of the Institute of Law

​The Institute of Law (incorporated under the Loi 1862 sur les teneures en fidéicommis et l’incorporation d’associations – “the Institute”)

Notice is given of an application to be brought before the Royal Court of Jersey on Friday 21 December 2018 at 10am seeking consent of the Royal Court to the following. That the Constitution of the Institute be amended as follows:

  • in Clause 3 (Objects), substitute clauses 3.1-3.7 with:
    • the advancement of education by teaching, learning, research and scholarship
    • to advance the academic study and development of Jersey and Guernsey law and related studies and to preserve the legal heritage of the Channel Islands
    • to contribute to the Jersey Legal Information Board’s strategy of making the law and legal process more accessible to the public
    • to provide structured programmes of legal education
    • to enable the public to obtain the advantages of higher education in Jersey and Guernsey through the provision of undergraduate and higher degree courses in law and of access to courses for those who do not have formal qualifications
    • to provide library facilities accessible by all
    • to do all such other lawful things as are incidental to or conducive to the attainment of the above Objects or any of them
  • in Clause 3 (Objects), delete clauses 3.8-3.15.
  • in Clause 7.6 (Governing Body) insert at (f) and (g) “at their discretion” and at (g) “or an independent reporting accountant.”
  • in Clause 7.6 (Governing Body) insert “(xx) To authorise remuneration to any member of the Governing Body for the provision of any professional services, provided that the Governing Body is satisfied that it is in the interests of the Institute of Law to do so.”
  • in clause 10.3 (Meetings of the Governing Body), substitute the date “30 September” with “31 July”
  • in Clause 10.9 (Meetings of the Governing Body), substitute “from among its members” with “being a natural or legal person or an institution”
  • in Clause 10.12 (Meetings of the Governing Body), substitute the date “30 September” with “31 July”
  • in Clause 10.13 (Meetings of the Governing Body), delete the word “Audited”
  • in Clause 13 (Representation), delete the words “or Secretary”
  • in Clause 15.1 (Discrimination) substitute “of any person’s origin, belief, gender, disability or sexual orientation” with “of any protected characteristic under the Discrimination (Jersey) Law 2013.”
