This Order was made by the Comité des Connétables on Friday 29 November 2019 and comes into force on 1 March 2020. This Order replaces the Dogs (Licence Duty) (Jersey) Regulations 2004 and introduces a new £10 dog licence fee which replaces the current £5 duty payable in respect of a licence.

These Regulations amend the Intellectual Property (Unregistered Rights) (Application, Transitional Provisions and Savings) (Jersey) Regulations 2012 to make provision to cater for the departure of the United Kingdom from the European Economic Area and make alternative provision about certain unregistered intellectual property rights in relation to the British Islands.

These Regulations specify certain offences in respect of which a person has been acquitted in a trial before the Royal Court, or on appeal against a conviction in the Royal Court, for the purposes of bringing an application to the Court of Appeal for an order to quash that acquittal, and to retry the person of the offence. These are known as “qualifying offences”.

These Regulations temporarily amend provisions of the Criminal Procedure (Jersey) Law 2018 to remove cross-references to other, not-in-force provisions until those provisions are brought into force. Recent Rules made under a Rule-making power that is now being substituted are treated as made under the power as substituted.

On Thursday 31 October 2019, the Act brings into force all of Parts 2, 3 and 10, Part 4 except for some words in Article 14, most of Part 9, and Articles 114, 116, 117 and 118 of the Criminal Procedure (Jersey) Law 2018.

These Regulations were made by the States on Wednesday 23 October 2019 and come into force on Wednesday 30 October 2019. These Regulations amend the Shops (Regulation of Opening) (Jersey) Regulations 2011 to introduce a new restricted-hours permit; this new permit allows any shop (including a shop with a retail sales area of over 700 m2) to open from 10 a.m. to 4 p.m. on Sundays and on certain holidays. The Regulations also remove the power to grant blanket permits.

This Law was registered in the Royal Court on Friday 18 October 2019 and came into force on 1 January 2019. The Law amends the Taxation (Companies – Economic Substance) (Jersey) Law 2019, which makes provision for imposing an economic substance test on certain companies regarded as resident in Jersey under Article 123 of the Income Tax (Jersey) Law 1961 and for determining whether the test is met by assessing the extent of certain activities carried out in Jersey by such companies.

This Law was registered in the Royal Court on Friday 18 October 2019 and came into force on Saturday 19 October 2019. The Law amends Article 3 of the Sanctions and Asset-Freezing (Jersey) Law 2019 so that anyone subjected to an asset-freeze by the European Union or the United Kingdom can be designated for the asset-freeze imposed by Part 3 of that Law, regardless of whether the United Nations requires the asset-freeze.

This Law was registered in the Royal Court on Friday 18 October 2019 and comes into force on a day to be appointed by Act of the States. The Law provides for the administration of taxes and other charges under various enactments which raise revenue for the States of Jersey, including the Income Tax (Jersey) Law 1961 and the Goods and Services Tax (Jersey) Law 2007, and renames the Comptroller of Taxes as the Comptroller of Revenue.

This Law was registered in the Royal Court on Friday 18 October 2019 and came into force on Saturday 19 October 2019. The Law amends the Emergency Powers and Planning (Jersey) Law 1990 to provide for additional persons to be members of the Emergencies Council established under the principal Law, it also amends the requirements in relation to meetings of the Council and provides for a competent authority in relation to medical supplies.

This Law was registered in the Royal Court on Friday 18 October 2019 and comes into force on a day to be appointed by Act of the States. The Law makes provision for improving access to justice by establishing a legal aid scheme.

This Order was made by the Minister for Health and Social Services on Tuesday 15 October 2019 and came into force on being made. This Order amends the Medicines (Prescription Only) (Jersey) Order 1997 in order to specify appropriate practitioners for the purposes of the Medicines (Jersey) Law 1995.

This Order was made by the Chief Minister on Monday 14 October 2019 and came into force on Tuesday 15 October 2019. This Order amends the Health Care (Registration) (Prescribed Qualifications) (Jersey) Order 2003 in order to prescribe qualification requirements for registrable occupations, within the meaning of the Health Care (Registration) (Jersey) Law 1995.

This Order was made by the Minister for the Environment on Tuesday 8 October 2019 and comes into force on Tuesday 22 October 2019. This Order makes amendments to various enactments concerning animal health and welfare, to implement the current versions of the relevant European Union legislation and to ensure that references to that legislation remain current in future, including after the United Kingdom leaves the European Union.

This Order gives temporary continuing effect to European Union legislation, in the fields of animal health and welfare, that had effect in Jersey immediately before the repeal of the European Union (Jersey) Law 1973, whenever that repeal is brought into force.

These Regulations make provision in relation to the application to Jersey of European Union requirements for monitoring residues of veterinary medicines and other substances in farm animals and animal products.

These Regulations were made by the States on Tuesday 8 October 2019 and came into force on Wednesday 9 October 2019. These Regulations amend the Electronic Communications (Jersey) Law 2000 to make further provision for the giving of information, signatures and documents by electronic means.

These Regulations amend the Health Care (Registration) (Jersey) Law 1995 in order to extend the definition of “registrable occupation”, with the effect of applying the provisions of that Law to the following occupations –
(a) optometrist independent prescriber;
(b) paramedic independent prescriber;
(c) pharmacist independent prescriber;
(d) physiotherapist independent prescriber;
(e) podiatrist independent prescriber; and
(f) therapeutic radiographer independent prescriber.

These Regulations were made by the States on Tuesday 8 October 2019 and come into force on Tuesday 15 October 2019. These Regulations amend the Charities (Transitional Provisions) (Jersey) Regulations 2018. The amendment extends for another year (2020) the preserved tax exemptions enjoyed in 2019 by any entity which applied for registration as a charity before the end of 2018, if the entity had not had that application finally determined before the end of 2019.

This Order transfers certain legislated responsibilities and functions that relate to children from the Minister for Health and Social Services to the Minister for Children and Housing.

This Order was made by the Minister for the Environment on Tuesday 1 October 2019 and came into force on Wednesday 2 October 2019. This Order prescribes a fee of £91.50 for a licence to harvest seaweed by hand for commercial purposes.

This Order was made by the Minister for the Environment on Monday 30 September 2019 and comes into force on Thursday 10 October 2019. This Order amends the Animal Health (Jersey) Law 2016 by –
(a) adding Psittacosis (otherwise known as Ornithosis), Rinderpest virus, Teschen disease and Trichinellosis to the diseases covered by the Law; and
(b) adding Psittacosis (otherwise known as Ornithosis) to the list of specified pathogens under the Law.

This Order was made by the Minister for the Environment on Monday 30 September 2019 and comes into force on Thursday 10 October 2019. This Order amends the Animal Health (Miscellaneous Exotic Diseases) (Jersey) Order 2017 so as to –
(a) add Psittacosis (otherwise known as Ornithosis), Rinderpest virus, Teschen disease and Trichinellosis and their susceptible animals to the schedule of diseases to which the Order applies;
(b) apply the power to kill animals to Rinderpest virus and Trichinellosis;
(c) add Rinderpest virus and Trichinellosis to the list of diseases to which additional measures set out in Schedule 3 to the Order apply.

These Regulations make provision in relation to the application of European Union food and feed standards to fish, crustaceans and molluscs harvested or caught (rather than farmed) in Jersey and the territorial sea around Jersey.

These Regulations amend the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016 to add 9 EU Regulations, which relate to food or feed, to the list of relevant EU instruments, to the extent that they relate to an aquaculture animal.

This Order amends the Police Procedures and Criminal Evidence (Codes of Practice) (Jersey) Order 2004 to give effect to the operation of revised Code C in the Schedule to the Codes of Practice Order, to enable records to be made in electronic form. Code C is the code of practice for the detention, treatment and questioning of persons by police officers.

This Order amends the Cycle Tracks (Jersey) Order 2000 to add new sections of shared pedal cycle/pedestrian cycle track in St. Helier along the La Route de la Libération and opposite Commercial Buildings; along St. Peter’s Valley, and to the west of Grouville Common.

This Order was made by the Minister for Social Security on Friday 20 September 2019 and comes into force on Tuesday 1 October 2019. This Order broadens the circumstances in which income and capital are disregarded for the purpose of calculating income support.

These Regulations were made by the States on Tuesday 10 September 2019 and came into force on being made. These Regulations transfer specified employees to the States of Jersey to reverse, in part, the transfer of staff to the Ports of Jersey Limited effected by the Air and Sea Ports (Incorporation) (Transfer No. 2) (Jersey) Regulations 2017.

These Regulations were made by the States on Tuesday 10 September 2019 and come into force on Tuesday 24 September 2019. These Regulations amend the Sanctions and Asset-Freezing (Jersey) Law 2019 to require the Jersey Financial Services Commission (“JFSC”) to provide information to the Minister if that information came to JFSC in the course of carrying out its functions and JFSC believes the information would facilitate the Minister’s functions or the investigation (and prosecution) of offences under the Law.

These Regulations were made by the States on Tuesday 10 September 2019 and come into force on Tuesday 17 September 2019. These Regulations make provision under the Aquatic Resources (Jersey) Law 2014 to restrict the circumstances in which certain species of seaweed may be harvested.

This Order was made by the Chief Minister on Wednesday 21 August 2019 and came into force on Thursday 22 August 2019. The Order transfers the responsibilities and functions of the Chief Minister under enactments and Orders in Council relating to data protection, digital matters and communications and broadcasting to the Minister for Economic Development, Tourism, Sport and Culture.

This Order was made by the Minister for Infrastructure on Friday 16 August 2019 and comes into force on Friday 23 August 2019. This Order makes amendments to traffic restrictions in St. Helier relating to one way traffic, prohibition on waiting, roads closed to, or for restricted use by, motor vehicles, parking places on roads and parking of vehicles in roads for loading and unloading.

This Order was made by the Minister for Home Affairs on Wednesday 7 August 2019 and came into force forthwith. This Order amends the Immigration (Fees) (Jersey) Order 2017 to set fees that must accompany applications for limited leave to remain in respect of students or their dependants; work permit holders or their dependants; and investors or their dependants; and provides that no fees are payable in respect of applications for leave to remain by a person, who for the purposes of the Jersey Immigration Rules is to be regarded as an EU citizen, a family member of an EEA citizen or a family member of a qualifying British citizen.

This Order was made by the Minister for the Environment on Wednesday 30 July 2019 and comes into force on Tuesday 6 August 2019. This Order, when read with Regulations 5 and 5A of the Sea Fisheries (Miscellaneous Provisions) (Jersey) Regulations 1998, prohibits the fishing, taking or storing of soft-shelled spider crabs during the period from 1 September 2019 to 15 October 2019 inclusive. During the same period, the Order also prohibits the use of passive fishing gear within the sea area specified in the Schedule.

This Order amends the Police Procedures and Criminal Evidence (Application to Customs and Excise) (Jersey) Order 2004 in order to further extend to customs officers certain police powers under the Police Procedures and Criminal Evidence (Jersey) Law 2003. Those powers are accompanied by certain safeguards for persons in relation to whom the police or customs officers exercise those powers.

This Law amends the Explosives (Jersey) Law 2014 to provide power for the States to make Regulations in respect of all types of pyrotechnic articles, including fireworks; enables a Centenier to impose a fine in relation to certain offences under the Law; and enables the Minister for Home Affairs to prescribe fees for the provision of technical or other advice.

This Law establishes the office of the Commissioner for Children and Young People and confers functions on the person holding that office to promote and protect the rights of children and young people in Jersey.

This Act brings into force on Wednesday 24 July 2019 the un-commenced provisions of Part 5 (bail and detention) and Article 108 (extended remand in customs custody of suspected drug offender) of the Police Procedures and Criminal Evidence (Jersey) Law 2003, as amended by Schedule 2 to the Criminal Procedure (Bail) (Jersey) Law 2017.

This Act was made by the States on Wednesday 17 July 2019 and came into force forthwith. This Act brings all of the Criminal Procedure (Bail) (Jersey) Law 2017 into force on Wednesday 24 July 2019, with the exception of one amendment contained in paragraph 4 of Schedule 2 to that Law.

(a) Part 1 (interpretation and application);
(b) Article 48 (which replaces the mode of trial provisions in Article 1 of the Loi (1864) réglant la Procédure Criminelle, which is repealed);
(c) Part 13 ( which establishes and sets out the functions of the Criminal Procedure Rules Committee);
(d) Article 115 (which enables Regulations under the Law to be made);
(e) Article 118 to the extent only to repeal Article 1 of the Loi (1864) réglant la Procédure Criminelle (listed in Schedule 5 at paragraph (4) of the Law); and
(f) Article 119 (citation and commencement).

These Regulations replace the Unlawful Public Entertainments (Jersey) Regulations 2016 on their expiry, and expire after another 3 years. It will remain an offence to hold a public entertainment without the permission of the Bailiff, or to contravene a condition on that permission.

These Regulations were made by the States on Tuesday 16 July 2019 and come into force on 1 October 2019. These Regulations amend the Income Support (Jersey) Regulations 2007 in order to –

  • increase all income support components, other than the single parent component (where there is no increase) and first child component, by 1.9%; and
  • increase the first child component by £5.04 per week.

This Order was made by the Minister for Health and Social Services on Tuesday 9 July 2019 and came into force on Wednesday 10 July 2019. This Order substitutes new provisions about the evidence that has to be produced to satisfy the Minister for Health and Social Services in order for a registered medical practitioner to be an approved practitioner for the purposes of the Mental Health (Jersey) Law 2016.

This Order was made by the Minister for Infrastructure on Friday 5 July 2019 and comes into force on Friday 12 July 2019. This Order makes provision for goods vehicles exceeding 3.5 tonnes first used on or after 1 October 1988 to be equipped with specified anchorage points and for goods vehicles exceeding 3.5 tonnes first used on or after 1 October 2001 to be equipped, in addition, with specified seat belts.

These Bye-laws were made by the Minister for the Environment on Thursday 4 July 2019 and comes into force on 1 October 2019. These Bye-laws amend the Building Bye-laws (Jersey) 2007 in relation to building work involving the removal of fixed gas burning appliances and requirements concerning the detection of carbon monoxide in all buildings where combustion appliances are installed, and site preparation and resistance to contaminants and moisture.

This Order revokes the States of Jersey (Proper Addresses for Ministers) (Jersey) Order 2014 and provides that the proper address for service of documents on any Minister is Ministerial Offices, 19-21 Broad Street, St Helier, Jersey JE2 3RR.

This Order was made by the Minister for Health and Social Services on Friday 28 June 2019 and comes into force on Monday 1 July 2019. This Order specifies relevant material that is excluded material and that a person may not act under an appointment made by another person to represent him or her after death in relation to express consent, if the person lacks capacity to understand the notion of consenting to a specified activity.

This Order was made by the Minister for Health and Social Services on Wednesday 26 June 2019 and came into force on Thursday 27 June 2019 except for Articles 1(3) and 2(7) which come into force on the 30th day after the day on which this Order was made. This Order makes a number of amendments to the Misuse of Drugs (Jersey) Law 1978, as well as to various Orders made under that Law, on the basis of recommendations of the Jersey Advisory Council on the Misuse of Drugs.

This Act was made by the States on Tuesday 18 June 2019 and came into force forthwith. The Act brings into force the whole of the International Co-operation (Protection from Liability) (Jersey) Law 2018 on the day this Act was made.

These Regulations were made by the States on Tuesday 18 June 2019 and come into force on Monday 1 July 2019. These Regulations provide that a decision to consent, or not to consent, and the appointment of a person under the Human Transplantation and Anatomy (Jersey) Law 2018 whether in relation to transplantation activities generally or one or more transplantation activities, may be recorded in the NHS Organ Donor Register.

This Act was made by the States on Tuesday 18 June 2019 and came into force forthwith. The Act brings into force the whole of the Human Transplantation and Anatomy (Jersey) Law 2018 on Monday 1 July 2019.

These Regulations were made by the States on Tuesday 18 June 2019 and came into force on being made. These Regulations amend the Public Employees (Pension Scheme) (Transitional Provisions, Savings and Consequential Amendments) (Jersey) Regulations 2015. The effect of the amendments are to compensate a transition member for a reduction in his or her final salary retirement benefits under the Public Employees Contributory Retirement Scheme (“PECRS”), with an award of additional pensionable service i.e. “added years”. The reduction in final salary retirement benefits would occur where the member’s earnings are reduced because of a workforce restructure or because of a re-evaluation of that member’s job and pay. The amendments have retrospective effect to 1st January 2019.

These Regulations were made by the States on Tuesday 18 June 2019 and come into force on Tuesday 25 June 2019. These Regulations amend 4 sets of Regulations which govern the Public Employees Contributory Retirement Scheme (“PECRS”). The effect of the proposed amendments would be to compensate members of the PECRS who suffer a reduction to their expected pension on retirement, with an award of additional service i.e. “added years”. A reduction in pension would occur where a member’s salary is reduced because of a workforce restructure or because of a re-evaluation of that member’s job and pay.

These Regulations amend the Banking Business (Jersey) Law 1991 to make provision for limited disclosure of information held by the Jersey Financial Services that originated from a participant in a college of supervisors established under Article 116 of Directive 2013/36/EU.

This Order amends the Income Support (General Provisions) (Jersey) Order 2008 to specify that persons in an interdependent relationship (defined in new Article 5(4) and (5), to be inserted into the 2008 Order by Article 1(3)(b)) are to be treated as members of the same household for the purposes of eligibility for income support under Article 2 of the Income Support (Jersey) Law 2007.

This Law amends the Bankruptcy (Désastre) (Jersey) Law 1990 in relation to the persons in respect of which an application for a declaration that the property of a person is en désastre may be made.

This Order excludes a person with registered status between the ages of 16 and 26 who is the child of a midwife, nurse or social worker, or who is the child of a co-habiting partner of a person with such an occupation, from being counted for the purpose of determining the maximum number of registered persons who are permitted to work for an undertaking under its business licence.

This Order was made by the Minister for the Environment on Thursday 28 March 2019 and came into force on Friday 29 March 2019. This Order amends the Sea Fisheries (Bag Limits) (Jersey) Order 2016 to increase the bag limit set in that Order for the catch of sea bass, to permit one fish per day to be taken during the period 1 April to 31 October inclusive in any particular year. Outside that period, the limit remains at zero.

These Regulations ensure that designations by the United Kingdom under the Terrorist Asset-Freezing etc. Act 2010 and the Policing and Crime Act 2017 will continue to have immediate effect in Jersey when the Sanctions and Asset-Freezing (Jersey) Law 2019 is brought into force.

It replaces a previous Order so that the enforcement of that Regulation is brought into line with the existing Jersey legislative framework.

This Order was made by the Minister for External Relations on Wednesday 6 March 2019 and came into force on Thursday 7 March 2019. This Order amends the Air Navigation (Fees) (Jersey) Order 2015 to provide for a fee of £78 to be payable for the grant of permission –

(a)  for an aircraft, registered outside Jersey, the United Kingdom or its Territories and Dependencies, to take on board or discharge any passengers or cargo in Jersey or be flown over Jersey for the purposes of aerial work; and

(b)  for a small unmanned aircraft to be flown for the purpose of aerial work.
