This Order was made by the Minister for Health and Social Services on Sunday 29 March 2020 and comes into force on Monday 30 March 2020 at 8 a.m. This Order declares a period of restricted movement under the Covid-19 (Screening, Assessment and Isolation) (Jersey) Regulations 2020. It also declares 8 a.m. on Monday 13 April 2020 as the end of that period.
The Order makes exceptions from the requirement not to go to (or remain in) a public place. The exceptions cover police officers, when acting as such, and authorised officers (defined in the Regulations to include health officers, as well as police officers), when acting as such. They also cover other persons when they are in a public place for the purpose of their work, if it is not reasonably possible for them to work from their home. Work includes charitable and voluntary work, and travel from home to work and back is treated as being for the purpose of work. There is also an exception for other persons who are required to go to (or remain in) a public place to fulfil a legal obligation.
The requirement under the Regulations applies to any public place. The Order adds that a private road or way is also to be treated as a public place if the public has access to it, whether for payment or otherwise.

These Regulations were made by the States on Friday 27 March 2020 and come into force on Saturday 28 March 2020. These Triennial Regulations make provision, in relation to the Coronavirus outbreak and until 30 September 2020 at the latest, for the compulsory screening, assessment and isolation of potentially infectious persons, and to allow a period of restricted movement to be declared by Order.

These Regulations were made by the States on Friday 27 March 2020 and come into force on Saturday 28 March 2020. These Regulations make provision for the Minister for Education to require the closure of school premises or day care accommodation including day carer premises, to prevent the infection by, and spread of Covid-19 (coronavirus). These Regulations also allow the Minister to implement arrangements for the education of compulsory school age children whilst those children are unable to attend school by reason of the closure of school premises.

This Order was made by the Minister for Health and Social Services on Wednesday 25 March 2020 and comes into force on Thursday 26 March 2020. This Order temporarily amends the Medical Practitioners (Registration) (General Provisions) (Jersey) Order 2014 during an emergency relating to the Covid-19 outbreak in Jersey.

These Regulations were made by the States on Tuesday 24 March 2020 and come into force on Wednesday 25 March 2020. These Regulations amend the Public Finances (Jersey) Law 2019, which modifies the way the Law operates when a state of emergency has been declared or the Minister is satisfied that there exists an immediate threat to the health or safety of the inhabitants of Jersey, to the stability of Jersey’s economy or to the environment. The amendments add further modifications for the duration of the period when the Minister is satisfied that those circumstances apply.

These Regulations were made by the States on Tuesday 24 March 2020 and come into force on Wednesday 25 March 2020. These Regulations make temporary changes to the Regulation of Care (Jersey) Law 2014, which describes what are “regulated activities” to be regulated under the Law. The changes are as a consequence of the outbreak of Covid-19 in Jersey.

These Regulations were made by the States on Tuesday 24 March 2020 and come into force on Wednesday 25 March 2020. These Regulations make temporary changes to certain requirements in respect of the registration of registered providers, the employment of workers and inspections by the Jersey Health and Social Care Commission in relation to activities regulated under the Regulation of Care regime as a consequence of the outbreak of Covid-19 in Jersey.

These Regulations were made by the States on Tuesday 24 March 2020 and come into force on Wednesday 25 March 2020. These Regulations amend the Statutory Nuisances (Jersey) Regulations 2017, to add a matter that constitutes a statutory nuisance to the list in the Statutory Nuisances (Jersey) Law 1999. The new statutory nuisance is any event at which persons gather, if the event is of such size or duration, and is held in such circumstances in relation to potential contamination or infection with Covid-19, as to be prejudicial to health or a nuisance.

This Act was made by the States on Tuesday 24 March 2020 and came into force forthwith. The Act brings into force Article 17, Articles 19 to 23, Articles 100 to 102 and Article 118 (to the extent that Article 14 of the Loi (1864) réglant la Procédure Criminelle and Article 7 and Part 3 of the Magistrate’s Court (Miscellaneous Provisions) (Jersey) Law 1949 is repealed) of the Criminal Procedure (Jersey) Law 2018 on Wednesday 25 March 2020.

These Regulations were made by the States on Tuesday 24 March 2020 and come into force on Wednesday 25 March 2020. These Regulations modify the operation of Part 5 (Registration of Births, Deaths and Marriages) of the Marriage and Civil Status (Jersey) Law 2001 as a consequence of the outbreak of Covid-19 in Jersey.

These Regulations were made by the States on Tuesday 24 March 2020 and come into force on Wednesday 25 March 2020. These Regulations amend the Unlawful Public Entertainments (Jersey) Regulations 2019, which expire in 2022 (unless renewed), to require organisers of public entertainments to obtain the permission of the Bailiff, and to comply with any conditions attached when the permission is granted. The effect of the amendment is that, when it appears to the Bailiff to be in the public interest, conditions can be added or varied after the permission was granted, or the permission can be revoked.

These Regulations were made by the States on Tuesday 24 March 2020 and came into force on the same day. These Regulations suspend the requirement, in the Cremation (Jersey) Regulations 1961, for a second registered medical practitioner to certify death for the purposes of an application for cremation. Those 1961 Regulations are also modified to confer a discretion on the Medical Referee to permit cremation without a certificate of death. These modifications would have effect only for the purposes of dealing with the current coronavirus epidemic.

This Order was made by the Minister for the Environment on Thursday 19 March 2020 and comes into force on Thursday 26 March 2020. This Order makes provision for the daily limit of fish that may be taken by any person, vessel or fishing boat (other than in relation to the taking of bass or tope by any person on a British fishing boat or French fishing boat in any part of the territorial sea in which the boat is authorised to fish).

These Regulations were made by the States on Wednesday 11 March 2020 and come into force in accordance with Regulation 53. These Regulations give effect in Jersey law to certain EU instruments concerning plant health and official controls in relation to plant health.

These Regulations were made by the States on Wednesday 11 March 2020 and come into force on Wednesday 18 March 2020. These Regulations amend the Sea Fisheries (Licensing of Fishing Boats) (Jersey) Regulations 2003, the effect of which is to prohibit fishing boats used for the purpose of recreational fishing on a fee paying basis, from operating without a fishing boat licence or an access permit.

This Order was made by the Minister for Health and Social Services on Friday 6 March 2020 and came into force on Saturday 7 March 2020. This Order updates the list of contagious and infectious diseases in the Notifiable Diseases (Jersey) Order 1988 by adding Covid-19 and Middle East Respiratory Syndrome (MERS). Notification of such diseases is obligatory under the Loi (1934) sur la Santé Publique.

These UK Regulations, which apply to Jersey, were registered in the Royal Court on Friday 28 February 2020 and come into force on 1 April 2020. These Regulations increase the amount payable for various categories of TV licence.

This Order was made by the Minister for External Relations on Wednesday 26 February 2020 and came into force on Thursday 27 February 2020. This Order amends the EU Legislation (Sanctions – Somalia) (Jersey) Order 2014 to give effect to Council Regulation (EU) 2020/169 of 6 February 2020 amending Regulation (EC) No 147/2003 concerning restrictive measures in respect of Somalia. Among other changes, the amendment adds a prohibition related to the supply (without prior authorisation) of listed components that can be used for improvised explosive devices.

This Order identifies and classifies controlled waters and sets objectives for their quality under powers set out in Article 12 of the Water Pollution (Jersey) Law 2000.

This Order was made by the Minister for the Environment on Wednesday 26 February 2020 and comes into force in accordance with Article 10. This Order designates Water Management Areas and imposes restrictions and requirements on business activities or operations for the purpose of minimising the risk of water pollution.

These Regulations were made by the States on Wednesday 26 February 2020 and come into force on Wednesday 4 March 2020. These Regulations make provision for the grant of Entitled status on social or economic grounds to require the approval of the Housing and Work Advisory Group established under the Control of Housing and Work (Jersey) Law 2012.

This Law was registered in the Royal Court on Friday 21 February 2020 and comes into force on a day to be appointed by Act of the States. The Law amends the Employment (Jersey) Law 2003 to create new rights for women who are pregnant and also for breastfeeding mothers. The Law also updates and consolidates the rights to leave for ante-natal and pre-adoption appointments and for parental leave.

This Order was made by the Minister for Infrastructure on Friday 21 February 2020 and comes into force on Sunday 1 March 2020. This Order amends the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2017 to increase the charges for parking in public parking places by an average of 2.4%. Excess charges are not affected.  This Order also lowers the carbon dioxide emission level required to attract lower parking charges in respect of any vehicle to no more than 50 grams of carbon dioxide per kilometre.

This Order was made by the Minister for External Relations on Friday 7 February 2020 and came into force on Saturday 8 February 2020. This Order amends the Air Navigation (Fees) (Jersey) Order 2015 to increase from £78 to £82 the fee for a grant of permission –
(a) for an aircraft, registered outside Jersey, the United Kingdom or its Territories and Dependencies, to take on board or discharge any passengers or cargo in Jersey or be flown over Jersey for the purposes of aerial work; and
(b) for a small unmanned aircraft to be flown for the purpose of aerial work.

This Order amends the Planning and Building (Island Plan) (Jersey) Order 2009, so as to permit persons who are planning inspectors and are also States’ employees to conduct examinations in public relating to a draft Island Plan under the Planning and Building (Jersey) Law 2002.

This Order was made by the Minister for External Relations on Wednesday 5 February 2020 and comes into force on Wednesday 12 February 2020. This Order amends the Money Laundering (Jersey) Order 2008 and makes consequential amendments to the Proceeds of Crime (Duties of Non-Professional Trustees) (Jersey) Order 2016.

This Order was made by the Chief Minister on Wednesday 22 January 2020 and comes into force in accordance with Article 17. This Order amends the Intellectual Property (Unregistered Rights) (Works of Foreign Provenance) (Jersey) Order 2012 which makes provision in relation to the application of the Intellectual Property (Unregistered Rights) (Jersey) Law 2011.

These Regulations were made by the States on Tuesday 21 January 2020 and come into force on 1 April 2020. These Regulations will, from 1 April 2020, increase by 3.81% the limits on the amounts that may be taken into account where an employer provides food or living accommodation to an employee as part of their employment package. The limits were last increased on 1 October 2019.

These Regulations permit the making of enquiries regarding spent convictions in processing an application for a licence to produce, supply, offer to supply or possess a controlled drug or to cultivate Cannabis plants.

These Regulations were made by the States on Tuesday 21 January 2020 and come into force on Tuesday 28 January 2020. These Regulations amend the Banking Business (Depositors Compensation) (Jersey) Regulations 2009, in order to add criminal offences and provisions about information. The amendments give the Board powers to demand relevant information from various persons, and a new power to demand information from banks, at any time and in a specified format, about their total holdings of eligible deposits (and other information relevant to functions under, or the operation of, the depositors compensation scheme).

This Order was made by the Minister for External Relations on Monday 20 January 2020 and came into force forthwith. The Order brings into force the whole of the European Union (United Kingdom Exit – Miscellaneous Amendments) (Jersey) Regulations 2019, Regulations 1 and 4 of the European Union (Financial Services – Miscellaneous Amendments) (Jersey) Regulations 2019 and Regulations 1, 6, 7 and 8 of the Intellectual Property (Unregistered Rights) (Application, Transitional Provisions and Savings) (Amendment) (Jersey) Regulations 2019, at 11pm on Friday 31 January 2020.

These Regulations, which were made by the Secretary of State for the Home Office on 24 September 2019, were registered in the Royal Court on Friday 17 January 2020 and come into force on Friday 24 January 2020. These Regulations amend the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010 by increasing the fees payable in relation to an application for the issue of a criminal record certificate or an enhanced criminal record certificate, and adding provision for a fee to be payable in relation to an application for the issue of a criminal conviction certificate.

These Regulations, which were made by the Secretary of State for the Home Office on 23 October 2012, were registered in the Royal Court on Friday 17 January 2020 and came into force on Saturday 18 January 2020. These Regulations amend Regulation 8 of the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010 to provide for the central records database to be held by the Secretary of State instead of the National Policing Improvement Agency.

This Order was made by the Minister for the Environment on Tuesday 31 December 2019 and came into force on Wednesday 1 January 2020. This Order increases (by 2.5%) certain fees chargeable under various enactments relating to the environment.

This Order was made by the Minister for Infrastructure on Monday 23 December 2019 and comes into force on Monday 30 December 2019. This Order makes provision for designated parking bays in the parish of St. Helier for electric vehicles made available for use by a car club to its members.

This Order was made by the Minister for Social Security on Friday 20 December 2019 and comes into force on 1 January 2020. This Order amends the Social Security (Contributions) (Jersey) Order 1975 to amend the basis on which the amount of full rate Class 2 contributions payable is calculated for any such contributions which are paid more than 12 months after they fall due.

This Order was made by the Minister for Infrastructure on Thursday 19 December 2019 and comes into force on 1 January 2020. This Order sets out fees for permits to carry out road works under the Road Works and Events (Jersey) Law 2016 and repeals the Road Works (Permit Fees) (Jersey) Order 2018.

This Order was made by the Chief Minister on Wednesday 18 December 2019 and comes into force on 1 January 2020. This Order makes provision for the fees set out in the Regulation of Care (Fees) (Jersey) Order 2018 to increase by 2.5%, in line inflation, with the exception of the £50 fee in Article 2 (annual fees) charged to individuals directly employed by the care receiver, which remains at £50.

This Order was made by the Chief Minister on Wednesday 18 December 2019 and comes into force on 1 January 2020. This Order amends the Nursing Homes (General Provisions) (Jersey) Order 1995 to increase the registration and annual fees set out in that Order by 2.5% in line with inflation. Those fees were last increased with effect from 1 December 2017.

This Order was made by the Minister for Health and Social Services on Tuesday 17 December 2019 and came into force on Wednesday 18 December 2019. This Order amends the Poisons (General Provisions) (Jersey) Order 1968 and the Poisons List (Jersey) Order 1986 to remove references to cannabis.

This Order was made by the Minister for External Relations on Monday 16 December 2019 and comes into force on Monday 23 December 2019. This Order provides that an annual return from a charity, registered under the Charities (Jersey) Law 2014, must relate to a year ending on the anniversary of the charity’s registration (or on another date agreed, within the first year of registration, with the Charity Commissioner). The annual report must be sent, and received, within 2 months after the end of the year to which it relates.

This Order was made by the Minister for External Relations on Monday 16 December 2019 and comes into force on Monday 23 December 2019. This Order amends the Charities (Additional Information) (Jersey) Order 2018 to add a requirement that an annual return must include a narrative statement of the manner in which the charity claims to have complied (or failed to comply) with its duty (its “public benefit duty”) to provide public benefit in accordance with its registered public benefit statement in the year concerned.

This Order was made by the Minister for Infrastructure on Friday 13 December 2019 and comes into force on 1 January 2020. This Order increases certain fees charged by Driver and Vehicle Standards from 1st January 2020 by an average of 2.5% (the fee increases being rounded to the nearest pound).

This Order implements Council Regulation (EU) 2019/1716 of 14 October 2019 concerning restrictive measures in view of the situation in Nicaragua. That Regulation imposes an asset-freeze, which will apply to persons to be listed in its Annex I (none were listed when the Order was made).

This Order implements Council Regulation (EU) 2019/1890 of 11 November 2019 concerning restrictive measures in view of Turkey’s unauthorised drilling activities in the Eastern Mediterranean. That Regulation imposes an asset-freeze, which will apply to persons to be listed in its Annex I (none were listed when the Order was made).

This Order was made by the Minister for External Relations on Wednesday 11 December 2019 and came into force on Thursday 12 December 2019. This Order repeals and replaces the EU Legislation (Sanctions) (General Provisions) (Jersey) Order 2014, adapting its provisions to the Sanctions and Asset-Freezing (Jersey) Law 2019.

These Regulations were made by the States on Tuesday 10 December 2019 and came into force on Wednesday 11 December 2019. These Regulations give the Minister for the Environment a temporary power to make Orders to implement an EU provision relating to agriculture and in particular Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products.

These Regulations were made by the States on Tuesday 10 December 2019 and come into force on 1 January 2020. These Regulations will amend the Data Protection (Registration and Charges) (Jersey) Regulations 2018 to vary the charging provisions.

This Order was made by the Minister for Health and Social Services on Monday 9 December 2019 and comes into force on 1 January 2020. This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014, to increase by approximately 2.6% the charges payable for the provision of long-term care services to persons aged 18 years or over in a care home or group home.

This Order was made by the Minister for Social Security on Friday 6 December 2019 and comes into force on 1 January 2020. This Order amends provisions of the Long-Term Care (Benefits) (Jersey) Order 2014 so as to increase the daily rate for each long-term care benefit comprising standard care costs, and the amount required to be paid towards standard care costs, by 2.6%.

This Order was made by the Minister for Home Affairs on Friday 6 December 2019 and comes into force on 1 January 2020. This Order increases various fees and charges associated with the Fire and Rescue Service and licensing fees under the Petroleum (Jersey) Law 1984. The fees and charges were last increased on 1 January 2019, and the increases range from 1.8% for certain training provided by the Fire and Rescue Service, to 36.3% in respect of the issue and amendment of fire certificates and of inspection of commercial or public premises for the provision of a fire safety report.

This Order was made by the Minister for Treasury and Resources on Friday 6 December 2019 and comes into force on 1 January 2020. This Order repeals and replaces the Taxation (Land Transactions) (LTT Statements and Receipts) (Jersey) Order 2009. This new Order revises the details required to be included in an LTT statement and an LTT receipt.

This Act was made by the States on Monday 2 December 2019 and came into force forthwith. The Act gives immediate effect to the Finance (2020 Budget) (Jersey) Law 201- (P.109/2019), (adopted, as amended, by the States on Monday 2 December 2019), as if it were a Law sanctioned by the Privy Council and registered in the Royal Court.

These Regulations were made by the States on Monday 2 December 2019 and come into force on 1 January 2020. These Regulations amend the Social Security (Jersey) Law 1974 so as to increase the upper income and upper earnings limit for the purposes of social security and long-term care contributions respectively, and also increase those contributions.

This Order was made by the Comité des Connétables on Friday 29 November 2019 and comes into force on 1 March 2020. This Order replaces the Dogs (Licence Duty) (Jersey) Regulations 2004 and introduces a new £10 dog licence fee which replaces the current £5 duty payable in respect of a licence.

These Regulations were made by the States on Tuesday 12 November 2019 and come into force on Tuesday 19 November 2019. These Regulations make provision to allow the finances of the Financial Services Ombudsman schemes in Jersey and Guernsey to be combined (as the boards and staff already are).

This Act was made by the Emergencies Council on Thursday 24 October 2019 and came into force on Friday 25 October 2019. The Act designates the Minister for Health and Social Services as the competent authority in relation to medical supplies.

This Order was made by the Chief Minister on Thursday 24 October 2019 and comes into force in accordance with Article 22. This Order amends the Intellectual Property (Unregistered Rights) (Works of Foreign Provenance) (Jersey) Order 2012 to make provision for the United Kingdom leaving the EU.

These Regulations were made by the States on Wednesday 23 October 2019 and come into force on Thursday 31 October 2019. These Regulations make provision for the new form of oath to be taken by jurors in criminal trials.

These Regulations were made by the States on Wednesday 23 October 2019 and come into force on Thursday 31 October 2019. These Regulations specify certain offences in respect of which a person has been acquitted in a trial before the Royal Court, or on appeal against a conviction in the Royal Court, for the purposes of bringing an application to the Court of Appeal for an order to quash that acquittal, and to retry the person of the offence. These are known as “qualifying offences”.

These Regulations were made by the States on Wednesday 23 October 2019 and come into force on Thursday 31 October 2019. These Regulations temporarily amend provisions of the Criminal Procedure (Jersey) Law 2018 to remove cross-references to other, not-in-force provisions until those provisions are brought into force. Recent Rules made under a Rule-making power that is now being substituted are treated as made under the power as substituted.

On Thursday 31 October 2019, the Act brings into force all of Parts 2, 3 and 10, Part 4 except for some words in Article 14, most of Part 9, and Articles 114, 116, 117 and 118 of the Criminal Procedure (Jersey) Law 2018.

These Regulations were made by the States on Wednesday 23 October 2019 and come into force on Wednesday 30 October 2019. These Regulations amend the Shops (Regulation of Opening) (Jersey) Regulations 2011 to introduce a new restricted-hours permit; this new permit allows any shop (including a shop with a retail sales area of over 700 m2) to open from 10 a.m. to 4 p.m. on Sundays and on certain holidays. The Regulations also remove the power to grant blanket permits.

The Law amends the Taxation (Companies – Economic Substance) (Jersey) Law 2019, which makes provision for imposing an economic substance test on certain companies regarded as resident in Jersey under Article 123 of the Income Tax (Jersey) Law 1961 and for determining whether the test is met by assessing the extent of certain activities carried out in Jersey by such companies.

This Law was registered in the Royal Court on Friday 18 October 2019 and came into force on Saturday 19 October 2019. The Law amends Article 3 of the Sanctions and Asset-Freezing (Jersey) Law 2019 so that anyone subjected to an asset-freeze by the European Union or the United Kingdom can be designated for the asset-freeze imposed by Part 3 of that Law, regardless of whether the United Nations requires the asset-freeze.

This Law was registered in the Royal Court on Friday 18 October 2019 and comes into force on a day to be appointed by Act of the States. The Law provides for the administration of taxes and other charges under various enactments which raise revenue for the States of Jersey, including the Income Tax (Jersey) Law 1961 and the Goods and Services Tax (Jersey) Law 2007, and renames the Comptroller of Taxes as the Comptroller of Revenue.

The Law amends the Emergency Powers and Planning (Jersey) Law 1990 to provide for additional persons to be members of the Emergencies Council established under the principal Law, it also amends the requirements in relation to meetings of the Council and provides for a competent authority in relation to medical supplies.

This Order amends the Medicines (Prescription Only) (Jersey) Order 1997 in order to specify appropriate practitioners for the purposes of the Medicines (Jersey) Law 1995.

This Order amends the Health Care (Registration) (Prescribed Qualifications) (Jersey) Order 2003 in order to prescribe qualification requirements for registrable occupations, within the meaning of the Health Care (Registration) (Jersey) Law 1995.

This Order makes amendments to various enactments concerning animal health and welfare, to implement the current versions of the relevant European Union legislation and to ensure that references to that legislation remain current in future, including after the United Kingdom leaves the European Union.

These Regulations amend the Health Care (Registration) (Jersey) Law 1995 in order to extend the definition of “registrable occupation”, with the effect of applying the provisions of that Law to the following occupations –
(a) optometrist independent prescriber;
(b) paramedic independent prescriber;
(c) pharmacist independent prescriber;
(d) physiotherapist independent prescriber;
(e) podiatrist independent prescriber; and
(f) therapeutic radiographer independent prescriber.

These Regulations amend the Charities (Transitional Provisions) (Jersey) Regulations 2018. The amendment extends for another year (2020) the preserved tax exemptions enjoyed in 2019 by any entity which applied for registration as a charity before the end of 2018, if the entity had not had that application finally determined before the end of 2019.

(a) adding Psittacosis (otherwise known as Ornithosis), Rinderpest virus, Teschen disease and Trichinellosis to the diseases covered by the Law; and
(b) adding Psittacosis (otherwise known as Ornithosis) to the list of specified pathogens under the Law.

(b) apply the power to kill animals to Rinderpest virus and Trichinellosis;
(c) add Rinderpest virus and Trichinellosis to the list of diseases to which additional measures set out in Schedule 3 to the Order apply.

These Regulations transfer specified employees to the States of Jersey to reverse, in part, the transfer of staff to the Ports of Jersey Limited effected by the Air and Sea Ports (Incorporation) (Transfer No. 2) (Jersey) Regulations 2017.

These Regulations were made by the States on Tuesday 10 September 2019 and come into force on Tuesday 24 September 2019. These Regulations amend the Sanctions and Asset-Freezing (Jersey) Law 2019 to require the Jersey Financial Services Commission (“JFSC”) to provide information to the Minister if that information came to JFSC in the course of carrying out its functions and JFSC believes the information would facilitate the Minister’s functions or the investigation (and prosecution) of offences under the Law.

These Regulations were made by the States on Tuesday 10 September 2019 and come into force on Tuesday 17 September 2019. These Regulations make provision under the Aquatic Resources (Jersey) Law 2014 to restrict the circumstances in which certain species of seaweed may be harvested.

The Order transfers the responsibilities and functions of the Chief Minister under enactments and Orders in Council relating to data protection, digital matters and communications and broadcasting to the Minister for Economic Development, Tourism, Sport and Culture.

This Order was made by the Minister for Infrastructure on Friday 16 August 2019 and comes into force on Friday 23 August 2019. This Order makes amendments to traffic restrictions in St. Helier relating to one way traffic, prohibition on waiting, roads closed to, or for restricted use by, motor vehicles, parking places on roads and parking of vehicles in roads for loading and unloading.

This Order was made by the Minister for Home Affairs on Wednesday 7 August 2019 and came into force forthwith. This Order amends the Immigration (Fees) (Jersey) Order 2017 to set fees that must accompany applications for limited leave to remain in respect of students or their dependants; work permit holders or their dependants; and investors or their dependants; and provides that no fees are payable in respect of applications for leave to remain by a person, who for the purposes of the Jersey Immigration Rules is to be regarded as an EU citizen, a family member of an EEA citizen or a family member of a qualifying British citizen.

This Order was made by the Minister for the Environment on Wednesday 30 July 2019 and comes into force on Tuesday 6 August 2019. This Order, when read with Regulations 5 and 5A of the Sea Fisheries (Miscellaneous Provisions) (Jersey) Regulations 1998, prohibits the fishing, taking or storing of soft-shelled spider crabs during the period from 1 September 2019 to 15 October 2019 inclusive. During the same period, the Order also prohibits the use of passive fishing gear within the sea area specified in the Schedule.

Those powers are accompanied by certain safeguards for persons in relation to whom the police or customs officers exercise those powers.

This Law amends the Explosives (Jersey) Law 2014 to provide power for the States to make Regulations in respect of all types of pyrotechnic articles, including fireworks; enables a Centenier to impose a fine in relation to certain offences under the Law; and enables the Minister for Home Affairs to prescribe fees for the provision of technical or other advice.

This Law establishes the office of the Commissioner for Children and Young People and confers functions on the person holding that office to promote and protect the rights of children and young people in Jersey.

This Act brings into force on Wednesday 24 July 2019 the un-commenced provisions of Part 5 (bail and detention) and Article 108 (extended remand in customs custody of suspected drug offender) of the Police Procedures and Criminal Evidence (Jersey) Law 2003, as amended by Schedule 2 to the Criminal Procedure (Bail) (Jersey) Law 2017.

This Act was made by the States on Wednesday 17 July 2019 and came into force forthwith. This Act brings all of the Criminal Procedure (Bail) (Jersey) Law 2017 into force on Wednesday 24 July 2019, with the exception of one amendment contained in paragraph 4 of Schedule 2 to that Law.

(a) Part 1 (interpretation and application);

(c) Part 13 ( which establishes and sets out the functions of the Criminal Procedure Rules Committee);

(e) Article 118 to the extent only to repeal Article 1 of the Loi (1864) réglant la Procédure Criminelle (listed in Schedule 5 at paragraph (4) of the Law); and

These Regulations replace the Unlawful Public Entertainments (Jersey) Regulations 2016 on their expiry, and expire after another 3 years. It will remain an offence to hold a public entertainment without the permission of the Bailiff, or to contravene a condition on that permission.

These Regulations were made by the States on Tuesday 16 July 2019 and come into force on 1 October 2019. These Regulations amend the Income Support (Jersey) Regulations 2007 in order to –

  • increase all income support components, other than the single parent component (where there is no increase) and first child component, by 1.9%; and
  • increase the first child component by £5.04 per week.

This Order was made by the Minister for Health and Social Services on Tuesday 9 July 2019 and came into force on Wednesday 10 July 2019. This Order substitutes new provisions about the evidence that has to be produced to satisfy the Minister for Health and Social Services in order for a registered medical practitioner to be an approved practitioner for the purposes of the Mental Health (Jersey) Law 2016.

This Order was made by the Minister for Infrastructure on Friday 5 July 2019 and comes into force on Friday 12 July 2019. This Order makes provision for goods vehicles exceeding 3.5 tonnes first used on or after 1 October 1988 to be equipped with specified anchorage points and for goods vehicles exceeding 3.5 tonnes first used on or after 1 October 2001 to be equipped, in addition, with specified seat belts.

These Bye-laws were made by the Minister for the Environment on Thursday 4 July 2019 and comes into force on 1 October 2019. These Bye-laws amend the Building Bye-laws (Jersey) 2007 in relation to building work involving the removal of fixed gas burning appliances and requirements concerning the detection of carbon monoxide in all buildings where combustion appliances are installed, and site preparation and resistance to contaminants and moisture.

This Order was made by the Minister for Health and Social Services on Friday 28 June 2019 and comes into force on Monday 1 July 2019. This Order specifies relevant material that is excluded material and that a person may not act under an appointment made by another person to represent him or her after death in relation to express consent, if the person lacks capacity to understand the notion of consenting to a specified activity.

This Order was made by the Minister for Health and Social Services on Wednesday 26 June 2019 and came into force on Thursday 27 June 2019 except for Articles 1(3) and 2(7) which come into force on the 30th day after the day on which this Order was made. This Order makes a number of amendments to the Misuse of Drugs (Jersey) Law 1978, as well as to various Orders made under that Law, on the basis of recommendations of the Jersey Advisory Council on the Misuse of Drugs.

This Act was made by the States on Tuesday 18 June 2019 and came into force forthwith. The Act brings into force the whole of the International Co-operation (Protection from Liability) (Jersey) Law 2018 on the day this Act was made.

These Regulations were made by the States on Tuesday 18 June 2019 and come into force on Monday 1 July 2019. These Regulations provide that a decision to consent, or not to consent, and the appointment of a person under the Human Transplantation and Anatomy (Jersey) Law 2018 whether in relation to transplantation activities generally or one or more transplantation activities, may be recorded in the NHS Organ Donor Register.

This Act was made by the States on Tuesday 18 June 2019 and came into force forthwith. The Act brings into force the whole of the Human Transplantation and Anatomy (Jersey) Law 2018 on Monday 1 July 2019.

These Regulations were made by the States on Tuesday 18 June 2019 and came into force on being made. These Regulations amend the Public Employees (Pension Scheme) (Transitional Provisions, Savings and Consequential Amendments) (Jersey) Regulations 2015. The effect of the amendments are to compensate a transition member for a reduction in his or her final salary retirement benefits under the Public Employees Contributory Retirement Scheme (“PECRS”), with an award of additional pensionable service i.e. “added years”. The reduction in final salary retirement benefits would occur where the member’s earnings are reduced because of a workforce restructure or because of a re-evaluation of that member’s job and pay. The amendments have retrospective effect to 1st January 2019.

These Regulations were made by the States on Tuesday 18 June 2019 and come into force on Tuesday 25 June 2019. These Regulations amend 4 sets of Regulations which govern the Public Employees Contributory Retirement Scheme (“PECRS”). The effect of the proposed amendments would be to compensate members of the PECRS who suffer a reduction to their expected pension on retirement, with an award of additional service i.e. “added years”. A reduction in pension would occur where a member’s salary is reduced because of a workforce restructure or because of a re-evaluation of that member’s job and pay.

This Order was made by the Minister for External Relations on Friday 14 June 2019 and came into force on Saturday 15 June 2019. This Order gives effect in Jersey to Council Regulation (EU) 2019/796 of 17 May 2019 concerning restrictive measures directed against cyber-attacks threatening the European Union or its Member States.

This Order was made by the Chief Minister on Thursday 13 June 2019 and came into force on Friday 14 June 2019. This Order updates the guidance issued under Article 2(5) of the Control of Housing and Work (Jersey) Law 2012. The updated guidance outlines the various criteria which must be, or may be, taken into account by the Assistant Chief Minister and the Housing and Work Advisory Group when making a decision as to whether to grant Entitled Status to a person under Regulation 2(1)(e) of the Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2013.

This Order was made by the Minister for External Relations on Wednesday 5 June 2019 and comes into force on Wednesday 12 June 2019. This Order amends the Money Laundering (Jersey) Order 2008 for the purpose of aligning the MLO with international anti-money laundering standards and methodology.

This Order was made by the Chief Minister on Friday 31 May 2019 and came into force on being made. This Order transfers the responsibilities and functions of the Chief Minister under various finance- and business-related enactments to the Minister for External Relations.

These Regulations were made by the States on Tuesday 21 May 2019 and come into force immediately upon the expiry of the Removal of Vehicles (Private Land) (Jersey) Regulations 2016 on Friday 21 June 2019. These Regulations make provision for the removal and disposal of motor vehicles from private land in the circumstances and in the manner described in the Regulations.

These Regulations were made by the States on Tuesday 21 May 2019 and come into force on Tuesday 28 May 2019. These Regulations amend the Schedule to the Sea Fisheries (Minimum Size Limits) (Jersey) Regulations 2001, with the effect that the minimum size limit for Chancre (edible) crabs which may be landed, offered for sale, sold or retained by fishermen, is increased from 14 centimetres to 15 centimetres.

These Regulations were made by the States on Tuesday 21 May 2019 and come into force on Tuesday 28 May 2019. These Regulations amend the Banking Business (Jersey) Law 1991 to make provision for limited disclosure of information held by the Jersey Financial Services that originated from a participant in a college of supervisors established under Article 116 of Directive 2013/36/EU.

This Order was made by the Minister for Social Security on Thursday 16 May 2019 and comes into force on Thursday 23 May 2019. This Order amends the Income Support (General Provisions) (Jersey) Order 2008 to specify that persons in an interdependent relationship (defined in new Article 5(4) and (5), to be inserted into the 2008 Order by Article 1(3)(b)) are to be treated as members of the same household for the purposes of eligibility for income support under Article 2 of the Income Support (Jersey) Law 2007.

This Order was made by the Minister for External Relations on Wednesday 8 May 2019 and came into force on Thursday 9 May 2019. This Order corrects a cross-reference in Article 5(4) of the EU Legislation (Sanctions – Republic of Maldives) (Jersey) Order 2018, which provides that certain offence provisions do not apply to the Minister, or to a delegate of the Minister, when acting as the competent authority.

This Order was made by the Minister for External Relations on Tuesday 7 May 2019 and comes into force on Wednesday 8 May 2019. This Order amends the Taxation (Implementation) (International Tax Compliance) (Common Reporting Standard) (Jersey) Regulations 2015 to make changes to the lists of participating jurisdictions that are covered by the Regulations.

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force on Sunday 26 May 2019. This Law amends the Bankruptcy (Désastre) (Jersey) Law 1990 in relation to the persons in respect of which an application for a declaration that the property of a person is en désastre may be made.

This Law also amends various provisions of the Banking Business (Jersey) Law 1991, the Collective Investment Funds (Jersey) Law 1988, the Financial Services (Jersey) Law 1998, the Financial Services Commission (Jersey) Law 1998, the Insurance Business (Jersey) Law 1996 and the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 in relation to limitation of liability; fees, liquidators, record keeping requirements, disclosure of information and penalties.

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force in accordance with Article 67. The principle purpose of this Law is to give effect to the Budget for 2019, approved by the States on 6th December 2018.

The Law makes provision for compensation in personal injury cases by requiring courts to apply a specified discount rate to an award of damages and by creating a statutory regime for awarding damages by way of periodical payments.

This Law was registered in the Royal Court on Friday 26 April 2019 and comes into force on Friday 3 May 2019. The Law makes amendments to criminal legislation to give further effect to the Council of Europe Convention on Cybercrime (Budapest, 2001) and amend the Regulation of Investigatory Powers (Jersey) Law 2005 to provide for the investigation of electronic data protected by encryption.

This Act was made by the Emergencies Council and signed by the Greffier of the States, for and on behalf of the Emergencies Council, on Thursday 10 April 2019 and came into force on being made. Under this Act, the Minister for Economic Development, Tourism, Sport and Culture; the Minster for Home Affairs and the Minister for External Relations, are designated by the Emergencies Council as the competent authorities in relation to port operations, postal services and telecommunications respectively.

This Order amends the Road Traffic (Public Parking Places) (Jersey) Order 2006 to add Le Port Car Park to the list of public parking places in St. Peter, with a maximum permitted stay of 12 hours in any continuous period of 24 hours. Long commercial vehicles and agricultural vehicles may be parked in Le Port Car Park without the written permission of the controlling body.

These Regulations make miscellaneous amendments to certain financial services Laws having regard to the United Kingdom’s exit from the European Union.

These Regulations amend the interpretation provision of the European Union (Jersey) Law 1973, to add explanatory material about the meaning of “the arrangements for the Channel Islands set out in the Treaties”  to take account of any withdrawal Agreement between the UK and EU.

These Regulations amend the Animal Health (Jersey) Law 2016, the Animal Welfare (Jersey) Law 2004 and the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016, to insert powers for the Minister by Order to make provision related to Brexit and European legislation in those fields until the end of 2020.

This Order was made by the Minister for Social Security on Tuesday 12 March 2019 and comes into force in accordance with Article 6. This Order makes amendments to subordinate legislation which are consequential upon the enactment of the Social Security (Amendment No. 23) (Jersey) Law 2018, which in turn made changes to update provisions relating to long term incapacity allowance, and to introduce consistency across regimes for re-determining claims and questions under the Social Security (Jersey) Law 1974.

This Order was made by the Minister for External Relations on Wednesday 6 March 2019 and came into force on Thursday 7 March 2019. This Order gives effect in Jersey to Council Regulation (EU) 377/2012 of 3 May 2012 concerning restrictive measures directed against certain persons, entities, and bodies threatening the peace, security or stability of the Republic of Guinea-Bissau (OJ L 119, 4.5.2012, p. 1.). It replaces a previous Order so that the enforcement of that Regulation is brought into line with the existing Jersey legislative framework.

This Order was made by the Minister for External Relations on Wednesday 6 March 2019 and came into force on Thursday 7 March 2019. This Order amends the Air Navigation (Fees) (Jersey) Order 2015 to provide for a fee of £78 to be payable for the grant of permission –

(a)  for an aircraft, registered outside Jersey, the United Kingdom or its Territories and Dependencies, to take on board or discharge any passengers or cargo in Jersey or be flown over Jersey for the purposes of aerial work; and

(b)  for a small unmanned aircraft to be flown for the purpose of aerial work.
