Recent enactments passed by the States Assembly

Description

This Law was registered in the Royal Court on 28 July 2017 and came into force on 29 July 2017. This Law provides for the holding of referendums, the establishment of a Commission to advise on referendum questions and designate lead campaign groups, for the control of referendum expenses, and related purposes.

Referendum (Jersey) Law 2017

This Law was registered in the Royal Court on 28 July 2017 and comes into force on a day to be appointed by Act of the States. The Law amends The Law Society of Jersey Law 2005 to provide for the recognition and disciplinary control of legal service bodies and to revise and improve the procedure for dealing with complaints of professional misconduct against advocates, solicitors and legal services bodies.

The Law Society of Jersey (Amendment No. 4) Law 2017

This Order was made by the Minister for External Relations on 27 July 2017 and came into force on 28 July 2017. This Order amends the EU Legislation (Sanctions - Iran) (Jersey) Order 2015 to implement Council Regulation (EU) 2017/964 of 8 June 2017, which amended Regulation (EU) No 267/2012. It also removes superfluous wording and exempts the competent authority from criminal liability.

EU Legislation (Sanctions - Iran) (Amendment No. 3) (Jersey) Order 2017

This Order was made by the Minister for External Relations on 26 July 2017 and came into force on 27 July 2017. This Order makes it a criminal offence to sell, supply, transfer, export, or providing financing in relation to, specified items which could be used for the smuggling of migrants and human trafficking.

EU Legislation (Sanctions - Libya) (Amendment No. 5) (Jersey) Order 2017

This Order was made by the Chief Minister on 26 July 2017 and came into force on 27 July 2017. This Order amends the Companies (Transfers of Shares - Exemptions) (Jersey) Order 2014 to add as an approved stock exchange the NYSE MKT (the New York Stock Exchange's market for small-cap companies).

Companies (Transfers of Shares – Exemptions) (Amendment No. 4) (Jersey) Order 2017

These Regulations were made by the States on 19 July 2017 and came into force on 26 July 2017. These Regulations amend the Waste Management (Jersey) Law 2005 (the “2005 Law”) so as to:

Clarify the circumstances in which land can be lawfully used for the purposes of carrying on controlled waste activities; and

After the description in R1 in Part 2 of Schedule 1 to the 2005 Law of what constitutes a waste recovery operation. The effect of the amendment is to permit waste (whiten the meaning of Article 1(1) of the 2005 Law) to be incinerated for the purposes of generating energy in an incineration facility which meets the efficiency requirements set out in the Framework Directive (written the meaning of Article 1(1) of the 2005 Law).

Waste Management (Amendment No. 2) (Jersey) Regulations 2017 on Jersey Legal Information Board

These Regulations were made by the States on 19 July 2017 and came into force on 26 July 2017. These Regulations amend the Control of Housing of Housing and Work (Jersey) Law 2012 to require the payment of an annual charge by businesses holding permits for Registered persons to work in or for an undertaking or for supplying services of such persons to another undertaking. (The amount of the annual charge is to be prescribed by Order under these Regulations.)

Control of Housing and Work (Amendment of Law – Annual Charges) (Jersey) Regulations 2017 on Jersey Legal Information Board

This Act was made by the States on 19 July 2017 and came into force forthwith. The Act brings into force the whole of the Commissioner for Standards (Jersey) Law 2017 on 24 July 2017.
