Recent enactments passed by the States Assembly

Description

This Law was registered in the Royal Court on 16 February 2018 and comes into force in accordance with Article 88. The Law repeals and replaces the Data Protection (Jersey) Law 2005 with provisions to protect the rights of individuals in relation to their personal data, and provide for the free movement of personal data, in a manner equivalent to and consistent with the General Data Protection Regulation (Regulation (EU) 2016/679 and an associated Directive, the Law Enforcement Directive (Directive (EU) 2016/680.

Data Protection (Jersey) Law 2018

This Law was registered in the Royal Court on 16 February 2018 and comes into force on 25 May 2018. The Law contains certain provisions that are equivalent to and consistent with the General Data Protection Regulation (Regulation (EU) 2016/679) and establishes the Data Protection Authority and its functions.

Data Protection Authority (Jersey) Law 2018

This Law was registered in the Royal Court on 16 February 2018 and comes into force on 23 february 2018. The Law amends the Loi (1880) sur la propriété foncière in order to allow a secured claim in the case of a judicial or contractual hypothec to be calculated by reference to the value from time to time or percentage from time to time of the secured land. It also lengthens from 10 to 30 years the period of time after which a creditor’s right of recourse against 3rd parties is barred by lapse of time.

Loi (2018) (Amendement No. 6) sur la propriété foncière

This Law was registered in the Royal Court on 16 February 2018 and comes into force on 23 February 2018. The Law amends the Maintenance Orders (Enforcement) (Jersey) Law 1999 to empower the Royal Court or the Petty Debts Court to direct the registration of maintenance orders in the Public Registry, and to provide that an order so registered would take effect as a judicial hypothec on the property of a person subject to an order.

Maintenance Orders (Enforcement) (Amendment No. 3) (Jersey) Law 2018

This Law was registered in the Royal Court on 16 February 2018 and came into force on 17 February 2018. The Law deletes the provision in the Royal Court (Jersey) Law 1948 which disqualifies a person from being appointed to the office of Jurat if that person has received “poor relief” in the preceding 12 months and makes a consequential amendment.

Royal Court (Amendment No. 15) (Jersey) Law 2018

This Law was registered in the Royal Court on 16 February 2018 and comes into force on 23 February 2018. The Law provides a statutory basis for the provision of official statistics and re-enacts with amendments existing legislation on the taking of a population census.

Statistics and Census (Jersey) Law 2018

This Order was made by the Minister for Infrastructure on 19 February 2018 and comes into force on 26 February 2018. This Order further amends the Road Traffic (St Clement) (Jersey) Order 1987 to change the prohibition of waiting on various roads in the parish of St Clement and to change the parking disc restriction on La Grève d’Azette in that parish.
