Recent enactments passed by the States Assembly

Description

These Regulations were made by the States on Tuesday 12 February 2019 and come into force on one or more dates and times specified by Order appointed by the Minister for External Relations. These Regulations make amendments to various Laws that refer to member states of the EU. The amendments ensure that the treatment of the UK by those Laws will not change when the UK ceases to be a member state of the EU.

This Order was made by the Minister for Home Affairs on Thursday 7 February 2019 and came into force forthwith. This Order amends the Immigration (Fees) Jersey) Order 2017 to remove the requirement for a fee to be payable where an application for leave to remain is made in respect of a person who under the Immigration Rules is to be regarded as an EU citizen, a family member of an EU citizen or a family member of a qualifying British citizen.

This Order was made by the Minister for Infrastructure on Friday 25 January 2019 and comes into force on Friday 1 February 2019. This Order sets fees for periodic technical inspections under the Road Traffic (Jersey) Law 1956. The fee is £30 for a light motor cycle or moped, or £90 for a minibus.

These Regulations were made by the States on Tuesday 15 January 2019 and come into force on Tuesday 22 January 2019. These Regulations amend the Jersey Rules of the Air 2017 set out in the Air Navigation (Rules of the Air) (Jersey) Regulations 2017 to incorporate the amendments made to the Single European Rules of the Air (SERA) by the Commission Implementing Regulation (EU) 2016/1185 of 20 July 2016 amending Implementing Regulation (EU) No 923/2012 as regards the update and completion of the common rules of the air and operational provisions regarding services and procedures in air navigation (SERA Part C) and repealing Regulation (EC) No 730/2006, (OJ L 196 21.7.2016, p. 3).

These Regulations were made by the States on Tuesday 15 January 2019 and came into force on being made. These Regulations, amend the Public Employees (Pension Scheme) (Administration) (Jersey) Regulations 2015; the Public Employees (Pension Scheme) (Membership and Benefits) (Jersey) Regulations 2015; and the Public Employees (Pension Scheme) (Transitional Provisions, Savings and Consequential Amendments) (Jersey) Regulations 2015.
Provisions relating to the calculation of final pensionable earnings for the purpose of retirement benefits, and the transfer of retirement benefits, and of the pension scheme, are amended. The respective amendments have retrospective effect to 1 January 2019.

These Regulations were made by the States on Tuesday 15 January 2019 and come into force on Tuesday 22 January 2019. These Regulations amend the Alternative Investment Funds (Jersey) Regulations 2012. They principally amend provisions to make them uniform with those used in the Collective Investment Funds (Jersey) Law 1988.

These Regulations were made by the States on Tuesday 15 January 2019 and come into force on Tuesday 22 January 2019. These Regulations amend the Collective Investment Funds (Jersey) Law 1988, the Banking Business (Jersey) Law 1991, the Financial Services (Jersey) Law 1998, the Insurance Business (Jersey) Law 1996 and the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 to permit the disclosure of certain information to third parties, which would otherwise be prohibited under each of those Laws.

This Order was made by the Minister for Home Affairs on Monday 14 January 2019 and came into force on Tuesday 15 January 2019. This Order amends the Immigration (Fees) (Jersey) Order 2017 to make provision for the fees to be payable by EU citizens if under the Jersey Immigration Rules, provision is made for the making of an application for leave to remain in Jersey in relation to a person, who for the purposes of those Rules is to be regarded as an EU citizen, a family member of an EU citizen or a family member of a qualifying British citizen.

This Order was made by the Minister for External Relations on Tuesday 8 January 2019 and comes into force on Wednesday 9 January 2019. This Order gives effect to Council Regulation (EU) 2018/2004 of 17 December 2018 (OJ L 322, 18.12.2018, p. 12), which amends Regulation (EU) 2016/44 concerning restrictive measures in view of the situation in Libya (the “principal Regulation”). Council Regulation (EU) 2018/2004 amends the description in Annex II to the principal Regulation of the persons, entities and bodies whose assets are frozen.

This Order, which was made by Her Majesty in Council on Wednesday 12 December 2018, was registered in the Royal Court on Friday 21 December 2018 and comes into force on Friday 28 December 2018. This Order in Council extends to Jersey, with modifications, sections 126 to 128 of the Nationality, Immigration and Asylum Act 2002 and sections 144 and 145 of the Immigration and Asylum Act 1999. These sections, as modified, enable provisions to be made in Regulations and Orders in respect of the collection and retention of biometric information from a person making an application for visa or entry clearance or for leave to enter or remain in Jersey.

This Law was registered in the Royal Court on Friday 21 December 2018 and comes into force on a day to be appointed by Act of the States. This Law provides for the establishment and regulation of limited liability companies.

This Order was made by the Minister for Health and Social Services on Friday 21 December 2018 and comes into force on Tuesday 1 January 2019. This Order makes lawful the use of certain medicines containing cannabis (and certain drugs related to cannabis), despite cannabis and those other drugs otherwise being Schedule 1 drugs for the purpose of the Misuse of Drugs (General Provisions) (Jersey) Order 2009.

This Order was made by the Minister for Infrastructure on Friday 21 December 2018 and comes into force on 1 August 2019. This Order sets out the qualifications required for supervisors and operatives who must be available whilst certain kinds of road works are carried out. Under Article 26 of the Road Works and Events (Jersey) Law 2016, a qualified supervisor must be available to give assistance at all times whilst certain road works are carried out and a trained operative must be present on site at all times.

This Order was made by the Minister for Infrastructure on Friday 21 December 2018 and comes into force on Friday 28 December 2018. This Order amends the list of specified road works in the Road Works (Specified Road Works) (Jersey) Order 2018, setting out the circumstances in which mobile scaffolding and similar structures are included in the list.  Amendments are also made so that certain activities relating to scaffolding are “specified road works” only if they require some form of temporary traffic control.

This Order was made by the Minister for Infrastructure on Friday 21 December 2018 and comes into force on Tuesday 1 January 2019. This Order increases the fees charged by Driver and Vehicle Standards (part of the Department for Infrastructure) from 1st January 2019 by an average of 2.5%.

This Order was made by the Minister for External Relations on Friday 21 December 2018 and came into force forthwith. This Order revokes the Community Provisions (Restrictive Measures – Eritrea) (Jersey) Order 2012.

This Order was made by the Minister for External Relations on Friday 21 December 2018 and came into force on Saturday 22 December 2018. This Order amends the EU Legislation (Sanctions – Somalia) (Jersey) Order 2014 so as to give effect in Jersey to Council Regulation (EU) 2018/1933 of 10 December 2018 (OJ L 314/9, 11.12.2018).

This Order was made by the Chief Minister on Thursday 20 December 2018 and comes into force on Tuesday 1 January 2019. This Order transfers the functions of the Minister of Health and Social Security to the Chief Minister with respect to the making of Orders relating to the regulation of the medical and associated professions and skin piercing and tattooing. The enactments referring to the transferred functions are consequentially amended.

This Order was made by the Chief Minister on Thursday 20 December 2018 and comes into force on Tuesday 1 January 2019. This Order sets out the fees payable under the Regulation of Care (Jersey) Law 2014.

This Order was made by the Minister for Home Affairs on Thursday 20 December 2018 and comes into force on Tuesday 1 January 2019. This Order increases various fees and charges associated with the Fire and Rescue Service and licensing fees under the Petroleum (Jersey) Law 1984. The fees and charges were last increased on 1 January 2018, and the increases range from 1.8% for certain training provided by the Fire and Rescue Service, to 57% in respect of the issue and amendment of fire certificates and of inspection of commercial or public premises for the provision of a fire safety report.

This Order was made by the Minister for Health and Social Services on Thursday 20 December 2018 and comes into force on Tuesday 1 January 2019. This Order reduces the requirement for inspection of nursing homes from not less than twice a year to not less than once a year. This means that the nursing homes that will remain regulated by the Nursing and Residential Homes (Jersey) Law 1994 will in future have the same inspection requirement that will apply to the homes that will be regulated under the Regulation of Care (Jersey) Law 2014 from Tuesday 1 January 2019.

This Order was made by the Minister for the Environment on Wednesday 19 December 2018 and comes into force on Tuesday 1 January 2019. The Order increases (by an average of 2.50%) certain fees chargeable under various enactments relating to the environment.

This Order was made by the Minister for Economic Development, Tourism, Sport and Culture on 14 December 2018 and comes into force on 1 January 2019. This Order increases certain fees under the Shipping (Fees) (Jersey) Order 2013 by an average of approximately 9.4% in most cases. The increases apply to some fees under the Shipping (Registration) (Jersey) Regulations 2004 and the Shipping (Local Small Ships Registration) (Jersey) Regulations 2004. These fees were last increased with effect from January 2016.

This Order was made by the Minister for Infrastructure on Friday 14 December 2018 and comes into force on Tuesday 1 January 2019. This Order sets out fees for permits to carry out road works under the Road Works and Events (Jersey) Law 2016.

This Order was made by the Minister for Social Security on Thursday 13 December 2018 and comes into force on Tuesday 1 January 2019. This Order further amends the Long-Term Care (Benefits) (Jersey) Order 2014 to increase by approximately 1.5% the value of a loan that may be provided to an eligible person for the purpose of making payments for long-term care.

This Order was made by the Minister for Infrastructure on Monday 10 December 2018 and comes into force on Friday 1 February 2019. This Order makes provision relating to the registration of certain trailers drawn by motor vehicles, when used on a road in Jersey on a journey that involves entering a country that is a party to the 1968 Vienna Convention on Road Traffic.

This Order was made by the Minister for Infrastructure on Monday 10 December 2018 and comes into force on Friday 1 February 2019. This Order makes general provision for a scheme for the periodic technical inspection of motor vehicles, under Article 78A of the Road Traffic (Jersey) Law 1956, for compliance with the Motor Vehicles (Construction and Use) (Jersey) Order 1998.

This Order was made by the Minister for Infrastructure on Monday 10 December 2018 and comes into force on Friday 1 February 2019. This Order amends the Motor Vehicles (Wearing of Seat Belts by Adults) (Jersey) Order 2009 to extend the requirement for anyone aged 14 or over to wear a seat belt, when driving or riding in certain vehicles, to medium-sized and large goods vehicles.

This Order was made by the Minister for Health and Social Services on Friday 7 December 2018 and comes into force on Tuesday 1 January 2019. This Order amends the Long-Term Care Services (Health and Social Services Charges) (Jersey) Order 2014 to increase by approximately 1.5% the charges payable for the provision of long-term care services in a care home or group home.

These Regulations were made by the States on Thursday 6 December 2018 and come into force on Monday 1 April 2019. These Regulations amend the Employment (Minimum Wage) (Jersey) Regulations 2004 to increase incrementally the maximum amounts which may be offset against the minimum wage where food and living accommodation, or living accommodation but not food, is provided by the employer to an employee.

These Regulations were made by the States on Thursday 6 December 2018 and come into force on Thursday 13 December 2018. These Regulations create Order-making powers to enable the implementation of a customs union between the United Kingdom and the Crown Dependencies, in particular as such a union is reflected in the agreement between the Governments of the United Kingdom and of Jersey to a customs union, in anticipation of the United Kingdom’s exit from the EU.

These Regulations were made by the States on Thursday 6 December 2018 and came into force forthwith. These Regulations revoke the Taxation (Agreements with European Union Member States) (Jersey) Regulations 2005.

These Regulations were made by the States on Thursday 6 December 2018 and come into force on Thursday 13 December 2018. These Regulations amend the Financial Services Ombudsman (Case-Fee and Levy) (Jersey) Regulations 2015 and Schedule 2 to the Financial Services Ombudsman (Jersey) Law 2014.

This Act was made by the States on Thursday 6 December 2018 and came into force forthwith. The Act gives effect to the Finance (2019 Budget) (Jersey) Law 201- (P.130/2018), (adopted by the States on Thursday 6 December 2018), as if it were a Law sanctioned by the Privy Council and registered in the Royal Court.

These UK Regulations, which were made by the Secretary of State on Friday 9 November 2018, was registered in the Royal Court on Friday 30 November 2018 and comes into force on Friday 7 December 2018. These Regulations extend to Jersey the amendments made to the Antarctic Regulations 1995 (S.I.1997/2967) by the Antarctic (Amendment) Regulations 2008 (S.I.2008/3066) and the Antarctic (Amendment) Regulations 2017 (S.I.2017/706).

This Order was made by the Minister for Infrastructure on Friday 23 November 2018 and came into force on  Friday 30 November 2018. This Order brings a car park in the Parish of Trinity, known as the Parc de la Petite Falaise, within the regime which regulates public parking places. The Parc de la Petite Falaise is made subject to 2 restrictions, namely that the maximum permitted stay is 12 hours in any continuous 24 hour period, and that no commercial vehicles over 15 feet in length may park there without the written permission of the controlling body, in this case the parochial authority.

This Order was made by the Minister for Social Security on Friday 23 November 2018 and comes into force on Tuesday 1 January 2019. This Order amends the Long-Term Care (Benefits) (Jersey) Order 2014 to uprate by approximately 1.5% the value of long-term care benefit comprising weekly standard care costs of long-term care.

These Regulations were made by the States on Tuesday 20 November 2018 and come into force on Tuesday 1 January 2019. These Regulations provide for holders of licences under the Nursing Agencies (Jersey) Law 1978 and persons carrying on homes registered under the Nursing and Residential Homes (Jersey) Law 1994 or those carrying on an unregistered activity of this type, to be treated for a limited period as registered providers of a home care service or a care home service respectively, under the Regulation of Care (Jersey) Law 2014

Provision is also made for enforcement action under the 1978 and 1994 Laws to continue and for records held by the Minister for Health and Social Services to be transferred to the Health and Social Care Commission established under the 2014 Law.

These Regulations were made by the States on Tuesday 20 November 2018 and come into force on Tuesday 1 January 2019. These Regulations transfer the functions of the Minister of Health and Social Services to the Health and Social Care Commission in relation to the regulation of the medical and associated professions and skin piercing and tattooing, other than in relation to the making of Orders. The functions of the Medical Officer of Health under the Health Care (Registration) (Jersey) Law 1995 (which functions are administrative functions that supported the Minister’s regulatory functions) are also transferred. The enactments referring to the transferred functions are consequentially amended.

These Regulations were made by the States on Tuesday 20 November 2018 and come into force on Tuesday 1 January 2019. These Regulations set out the requirements imposed on persons seeking registration as care providers under the Regulation of Care (Jersey) Law 2014 and on those registered under that Law (registered providers and registered managers, known collectively as “registered persons”).

These Regulations were made by the States on Tuesday 20 November 2018 and come into force on Tuesday 1 January 2019. These Regulations amend the Regulation of Care (Jersey) Law 2014 so as to describe as regulated activities for the purpose of that Law –

(a) the provision of a care home service;
(b) the provision of a home care service; and
(c) the provision of an adult day care service.

The Regulations also make small changes to other legislation that are largely consequential on the commencement of the 2014 Law.

This Act was made by the States on Tuesday 20 November 2018 and came into force forthwith. The Act brings into force on Tuesday 1 January 2019 the remaining provisions of the Regulation of Care (Jersey) Law 2014 which are not currently in force.

These Regulations were made by the States on Tuesday 20 November 2018 and come into force on Tuesday 27 November 2018. These Regulations amend the list of provided schools in Part 1 of Schedule 1 to the Education (Jersey) Law 1999 to remove d’Hautrée House School from the list and to include La Sente School in the list.

These Regulations were made by the States on Tuesday 20 November 2018 and come into force on Tuesday 4 December 2018. These Regulations amend the Motor Vehicles (International Circulation) (Jersey) Regulations 1958 and the Road Traffic (Jersey) Law 1956, to make provision to facilitate the extension to Jersey of the Convention on Road Traffic done at Vienna on 8 November 1968.

This Order was made by the Minister for the Environment on Monday 19 November 2018 and comes into force on Saturday 1 December 2018. This Order makes provision in relation to inspection of rented dwellings for the purposes of assessing, under the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018, whether they pose particular kinds of hazard to health and safety, and also sets out minimum standards of health and safety which must be met by the landlord of a rented dwelling: in particular, standards as to the provision of smoke and carbon monoxide detectors, and as to gas safety and electrical safety.

This Order was made by the Chief Minister on Tuesday 13 November 2018 and came into force on Wednesday 14 November 2018. This Order amends the Collective Investment Funds (Recognized Funds) (Permit Conditions for Functionaries) (Jersey) Order 1988 to require “relevant holders” (defined in that Order) to ensure, in relation to each complaint relating to the conduct of its business as a functionary of a recognized fund made to it by any person, that the complainant is reminded that it is open to the complainant to report the matter to the Office of the Financial Services Ombudsman, and that if the complainant is dissatisfied with the outcome of the relevant holder’s investigation of the complaint, the complainant may ask that Office to investigate the complaint.

This Act was made by the States on Tuesday 6 November 2018 and came into force forthwith. The Act brings into force the whole of the Sexual Offences (Jersey) Law 2018 on Friday 23 November 2018.

These Regulations were made by the States on Tuesday 6 November 2018 and come into force on Friday 23 November 2018. These Regulations amend the Sexual Offences (Jersey) Law 2018 to ensure it still repeals what was Article 2(2) of the Marriage and Civil Status (Jersey) Law 2001, now that the Marriage and Civil Status (Amendment No. 4) (Jersey) Law 2018 has renumbered that provision as Article 4(2).

These Regulations were made by the States on Tuesday 6 November 2018 and come into force on Friday 23 November 2018. These Regulations make amendments that are consequential on the Sexual Offences (Jersey) Law 2018, to update references in other enactments to sexual offences that are repealed by the Law, by substituting new equivalents.

This Order was made by the Minister for Infrastructure on Friday 2 November 2018 and comes into force on Tuesday 14 May 2019. This Order amends the Motor Vehicles (Construction and Use) (Jersey) Order 1998 to extend the requirement for annual examination and certificates of compliance to medium-sized goods vehicles.

This Order was made by the Minister for Social Security on Friday 2 November 2018 and comes into force on Monday 1 April 2019. This Order amends the Employment (Minimum Wage) (Jersey) Order 2007 to increase the minimum wage, with effect from 1 April 2019, to £7.88 per hour for employees other than trainees, £5.91 per hour for trainees in their first year, and £6.90 per hour for trainees in their second year; and to further increase the minimum wage, with effect from 1 October 2019, to £8.02 per hour for employees other than trainees, £6.02 per hour for trainees in their first year, and £7.02 per hour for trainees in their second year.

This Order was made by the Minister for External Relations on Thursday, 1 November 2018 and comes into force on Friday, 2 November 2018. This Order gives effect in Jersey to Council Regulation (EC) No 1210/2003 of 7 July 2003 (OJ L 169, 8.7.2003, p. 6) concerning certain specific restrictions on economic and financial relations with Iraq, to any extent that the relevant United Nations Security Council resolutions have not already been given effect in Jersey (whether by virtue of that Regulation or under the relevant Orders in Council).

This Order was made by the Minister for External Relations on Friday, 26 October 2018 and comes into force on Saturday, 27 October 2018. This Order gives effect in Jersey to Council Regulation (EU) 2018/1542 of 15 October 2018 concerning restrictive measures against the proliferation and use of chemical weapons (OJ L 259, 16.10.2018, p.12).

This Law was registered in the Royal Court on Friday, 19 October 2018 and comes into force on Friday, 26 October 2018. The Law amends the Social Security (Jersey) Law 1974 to make technical amendments to the benefit known as Long-Term Incapacity Allowance (“LTIA”).

This Law was registered in the Royal Court on Friday, 19 October 2018 and comes into force on Friday, 26 October 2018. This Law further amends the Proceeds of Crime (Jersey) Law 1999 so that there is no requirement for there to have been 2 qualifying offences within a period of 6 years ending when the proceedings were instituted against the defendant for the Royal Court to make the assumptions provided for in Article 5 of that Law. In addition, the definition for the term “criminal property” in Article 29 of the Proceeds of Crime (Jersey) Law 1999 is widened to include property derived from or obtained, directly or indirectly, through criminal conduct  and property that is used in, or intended to be used in, criminal conduct.

This Law was registered in the Royal Court on Friday, 19 October 2018 and comes into force on a day or days to be appointed by Act of the States. This Law makes provision for protection from liability against claims for damages, costs and consequential loss in cases where a public authority provides assistance pursuant to a request made by a relevant authority of a country or territory outside Jersey.

This Law was registered in the Royal Court on Friday, 19 October 2018 and comes into force on Friday, 26 October 2018. The Law amends the Financial Services Commission (Jersey) Law 1998, to give the Jersey Financial Services Commission the power to impose a civil financial penalty on a principal person, and to provide for the Director General of the Commission to be an ex-officio Commissioner of the Commission.

This Order was made by the Minister for Economic Development, Tourism, Sport and Culture on Friday, 19 October 2018. Article 2 comes into force on Friday, 26 October 2018 and the remainder of the Order comes into force on Tuesday, 1 January 2019. This Order increases the fees charged under 3 regimes administered by the Minister for Economic Development, Tourism, Sport and Culture by approximately 2.5%.

This Order was made by the Minister for External Relations on Friday, 12 October 2018 and comes into force on Friday, 19 October 2018. This Order amends the Taxation (Double Taxation) (Jersey) Regulations 2010 to add Cyprus, the United Arab Emirates and the United Kingdom to the list of countries with which Jersey holds double taxation agreements.

This Order was made by the Minister for Social Security on Friday, 12 October 2018 and comes into force on Friday, 19 October 2018. This Order sets out the conditions and process for doctors who are not practising as general practitioners (and who are therefore not on the “performers list” for the purposes of the Health Insurance (Jersey) Law 1967) to be approved by the Minister as medical prescribing practitioners who may prescribe pharmaceutical benefit at cost to the Health Insurance Fund.

These Regulations, which were made by the Secretary of State for the Home Office on 10 March 2011, was registered in the Royal Court on Friday, 5 October 2018 and came into force on 6 April 2011. These Regulations amend the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010 by increasing the fee for an application made under section 113B of the Police Act 1997 of the United Kingdom (as extended to Jersey) for an enhanced criminal records certificate from £36 to £44 with effect from 6 April 2011. No fee is payable in relation to an application made by a volunteer under this section.

This Order was made by the Minister for Infrastructure on Monday, 1 October 2018 and comes into force on Monday, 15 October 2018. This Order amends the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017 to increase by approximately 3.3% the fares and charges payable for the hire of cabs. The fares and charges were last increased on 1 July 2017.

This Order was made by the Minister for the Environment on Friday, 28 September 2018 and comes into force on Saturday, 29 September 2018. This Order amends the Sea Fisheries (Bag Limits) (Jersey) Order 2016 to set the bag limit for bass (Dicentrarchus labrax) on any day to one fish during the months of October, November and December 2018 and zero fish on any day after 31 December 2018.

This Order was made by the Minister for Health and Social Services on Friday, 28 September 2018 and comes into force on Monday, 1 October 2018. This Order replaces the Mental Health (Review Tribunal) (Procedure) (Jersey) Order 1971, and makes updated provision to reflect the Mental Health Review Tribunal’s new role under both the Mental Health (Jersey) Law 2016 and the Capacity and Self-Determination (Jersey) Law 2016.

This Order was made by the Minister for Health and Social Services on Friday, 28 September 2018 and comes into force on Monday, 1 October 2018. This Order makes provision for miscellaneous matters which are to be prescribed under the Mental Health (Jersey) Law 2016 (the “Law”), and in particular (by Article 6 and Part 2 of the Schedule) prescribes forms to be used for certain applications, nominations and authorizations etc. under the Law.

This Order was made by the Minister for Health and Social Services on Friday, 28 September 2018 and comes into force on Monday, 1 October 2018. This Order makes provision as to various matters of detail which are to be prescribed in relation to the operation of, and under powers in, the Capacity and Self-Determination (Jersey) Law 2016 and the Capacity and Self-Determination (Supervision of Delegates etc.) (Jersey) Regulations 2018, including forms to be used for the purposes of the Law and Regulations, and fees chargeable under them.

This Order was made by the Minister for External Relations on Tuesday, 18 September 2018 and came into force on Wednesday, 19 September 2018. This Order amends the Schedule to the Taxation (Exchange of Information with Third Countries) (Jersey) Regulations 2008 to insert items and entries relating to Chile and Spain in the list of third countries with which Jersey has taxation exchange of information agreements.

This Order was made by the Minister for External Relations on Tuesday, 18 September 2018 and came into force on the same day. This Order brings into force, on the day after it is made, all but 4 of the Articles of the European Union (Repeal and Amendment) (Jersey) Law 2018, which was registered by the Royal Court on Friday, 1 June 2018.

This Order amends the EU Legislation (Sanctions – South Sudan) (Jersey) Order 2015 to give effect to Council Regulation (EU) 2018/1116 of 10 August 2018 (OJ L 204, 13.8.2018, p. 6) amending Regulation (EU) 2015/735 concerning restrictive measures in respect of the situation in South Sudan.

This Order was made by the Minister for Education on 10 August 2018 and comes into force on 1 September 2018. This Order makes provision for grants and allowances for higher education replacing the current Education (Discretionary Grants – General) (Jersey) Order 2008 and the Education (Discretionary Grants – Amounts) (Jersey) Order 2008.

This Order was made by the Minister for External Relations on Thursday 2 August 2018 and came into force on Friday 3 August 2018. This Order gives effect in Jersey to Council Regulation (EU) 2018/1001 of 16 July 2018 concerning restrictive measures in view of the situation in the Republic of Maldives (OJ L 180, 17.7.2018, p.1.).

This Order was made by the Chief Minister on 26 July 2018 and comes into force on 2 August 2018. This Order amends the Financial Services Commission (Financial Penalties) (Jersey) Order 2015 to include in the Schedule to that Order a new band of financial penalty that the Commission may impose to cover negligent contraventions of a Code of Practice to which Article 21A of the Financial Services Commission (Jersey) Law 1998 applies. The maximum level of penalty that would be imposed for such a contravention is 7% of relevant income (as defined in, and calculated in accordance with, Article 2 of the Financial Services Commission (Financial Penalties) (Jersey) Order 2015) up to a maximum of £4,000,000.

This Order was made by the Minister for the Environment on Tuesday 24 July 2018 and comes into force on Tuesday 31 July 2018. This Order prohibits the fishing, taking or storing of soft-shelled spider crabs during the period from Saturday 1 September 2018 to Monday 15 October 2018 inclusive. During the same period the Order also prohibits the use of passive fishing gear within the sea area specified in the Sea Fisheries (Miscellaneous Provisions) (Jersey) Regulations 1998.

This Order was made by the Chief Minister on Friday 20 July 2018 and came into force on Saturday 21 July 2018. This Order establishes a Minister for International Development and renames the Minister for Housing as the Minister for Children and Housing.

This Law was registered in the Royal Court on Friday 20 July 2018 and comes into force on a day to be appointed by Act of the States. The Law prescribes the procedure to be followed in, or in connection with criminal proceedings against a person charged with, or convicted of an offence.

The Law also introduces new measures to provide for the quashing of acquittals by the Court of Appeal and amends the Police Procedures and Criminal Evidence (Jersey) Law 2003 in relation to hearsay and bad character evidence in criminal proceedings.

This Law was registered in the Royal Court on Friday 20 July 2018 and comes into force on Monday 20 August 2018. The Law provides for the circumstances in which assets suspected of being tainted property may legally be seized by authorized officers, and placed under restraint or ultimately forfeited, by order of the court.

The Law makes provision concerning the storage, removal and use of the body, or relevant material from the body, of a deceased person for the purposes of transplantation, teaching of anatomy, medical education or research and therapeutic purposes.
