A construction company accused of breaking the health and safety law after two workers received electric shocks from a cable discovered under a traffic cone has been found not guilty after a Royal Court trial.
Rok Homes had been charged with a breach of section 21 of the Jersey Health and Safety at Work law after an incident in which two contractors suffered electric shocks while working on a building site.
Delivering the verdict during a two-minute hearing, Commissioner Sir Michael Birt – who sat on the case with Jurats Pamela Pitman and Gareth Hughes – said that the Jurats were unanimous in finding the company not guilty.
The court had heard that a live cable had first been discovered on the site at West Hill in November 2020, and again on 5 December, and that two employees from Geomarine had subsequently received shocks while working on the site in early February 2021, although neither was seriously injured.
Rok Homes' Project Director Marc Godel had argued that Jersey Electricity had been told about the cable on several occasions prior to the day the workmen suffered shocks, and that the utility company had made "a big contribution" to the risk.
