Having been late night shopping on 19 December, Dale Simon met a friend, and they went for some drinks.

Five pints later, Simon found himself in Folies on the dance floor.

This was at the same time as another man he knew – Person A, the complainant – although the Court heard that person wasn’t a friend or an acquaintance. Person A was with a companion, Person B, who started to have words with Simon. As Person B tried to walk away, Simon grabbed him, and so Person A came to intervene, but Simon head butted him in the face.

Simon was then reported to the doormen, and arrested.

Crown Advocate Fiona Russell told Judge Gary Perry that in interviews with Guernsey Police, Simon declined to comment to any questions answered, and in a follow up interview just said “they pushed me and started it”.

Duty Advocate Candice Fletcher said Simon was extremely remorseful reflecting on what he had done, however.

Judge Perry ordered Simon complete 80 hours of community service, in direct alternative to two and a half months in prison. He also gave down a probation order, with an additional condition to attend the criminal justice substance service to tackle an alcohol problem.

He made this order at the recommendation of the probation report, despite saying head butting was always treated “extremely seriously” by the Courts.
