Rosina Frances Cutler admitted the offence of assault when she appeared in the Magistrate’s Court yesterday – but said she “didn’t normally spit”.
St. Helier Centenier Shirley Madden, prosecuting, said the incident had taken place At 00:30 on 11 June.
Cutler (30) was in the smoking area outside Havana nightclub in Bath Street and had asked a man for a light.
She then began conversing with him but was told by another man that she should not be speaking to him because he was married. There was an argument and she was ejected from the smoking area.
The Centenier said: “She leaned over the railings and spat in the man’s face. Ms Cutler admitted the offence and said: “I don’t normally spit.’”
Cutler has no previous convictions. Advocate Darry Robinson, defending, noted that the offence was “very out of character.”
He addd: “She knows she should have walked away and she didn’t. She is very apologetic to the court and the complainant.”
He suggested a binding over order, saying: “She assures the court that she will never be seen before it again.”
But Relief Magistrate Sarah Fitz described the offence as “particularly unpleasant” and said: “I don’t think a binding order is sufficient.”
