Following an arduous seven years of litigation, judgement was found in favour of the executive and non-executive directors involved in the much publicised Carlyle Capital Corporation case. Panelists will discuss what the impact this case will have.
Whilst the judgment may have brought further clarity in respect to certain obligations of directors, questions will be asked about whether it brings comfort to directors, or does the prevailing fear of litigation mean the prospects facing directors are becoming increasingly challenging? And, are those risks just too high or are the rewards worth it – reputationally, financially and personally?
Lawyers Ian Swan (partner at Babbé) and Gareth Bell (partner from Collas Crill) who represented the NEDs and directors in the Carlyle case, will be taking part in the panel session joined by Anne Ewing (non-executive director), Peter Mills (financial services advisor, Optimus Group) and Rupert Dorey (a member of Guernsey Chamber of Commerce).
