BETWEEN Jason Drummond (the "Defendant") OF THE ONE PART; and Andium Homes Limited

(the "Plaintiff") OF THE OTHER PART; actioning the Defendant to show cause why:

1) the residential tenancy agreement dated 8th January 2021 (the "Lease") entered into between the parties in respect of the premises known as 19 Windsor Court, Windsor Road, St. Helier (the "Property"), should not be terminated, pursuant to Article 12(4) of the Residential Tenancy (Jersey) Law 2011 (the "Law") on the grounds that the said Lease has been breached by virtue of the Defendant's failure to pay his rent, and which breach has not been rectified and is continuing, notwithstanding the issuance of notices on 4th October 2021, 8th April 2022 and 23rd August 2022;

2) his eviction by the Officer of the Court should not be ordered from the premises under Article 12(4) of the Law; and

3) he should not be condemned to pay;

a) the sum of £8,001.03 which the Plaintiff claims to be outstanding from the Defendant in respect of unpaid rent, pursuant to the terms of the Lease (the "First Outstanding Sum");

b) interest on the Outstanding Sum, or any balance thereof, which has accrued and which might continue to accrue, in accordance with the terms of the Lease and calculated by reference to the contractual interest rate of 5% per annum, until such time as payment is received in full;

c) costs of an incidental to these proceedings, on such basis as the Court deems just; and;

d) stamp duty in the sum of £130.00 (which can be deducted if payment is made five days before the date given above). Summons served by the Officer of the Court. NOW TODAY; the Defendant having failed to appear but having heard from the Plaintiff through their lawyer, the Court ordered:

1) that the said residential tenancy agreement be terminated forthwith;
