"She was a wreck, she was hysterical"

Wednesday 15 February 2023

The partner of a woman who claims a man climbed into her bed and attempted to rape her has strongly denied that he was actually the one responsible for the alleged offence rather than the defendant.

The alleged victim’s partner was grilled on the second day of the trial of Thomas Matthew Jackson (35) - who denies two counts of sexual touching and one of attempted rape - by Adovcate Allana Binnie, who was defending.

"No I did not do the things that she alleged," he said during cross-examination. "How dare you."

The woman's partner was also cross-examined by Crown Advocate Matthew Maletroit, prosecuting, about her demeanour in the wake of the alleged sexual attack.

"I thought a loved one had passed away, she was very physically shaken, she wanted to tell me something," he said.

"[The complainant] was a car crash, she was a wreck, she was hysterical."

The partner admitted that he had drunk eight or nine beers, half a glass of champagne and a small shot on the evening of the alleged incident, and that the alleged victim was also "very, very drunk."

The trial is continuing today. This morning, Mr Jackson took to the stand to give evidence.
