In the early hours of 21 October, officers were called to reports of disturbance at Daniel Pengelley’s flat.
He had returned home after drinking at the De La Rue pub and, when officers arrived, both he and another person at the flat had injuries.
When they arrested him on suspicion of assault he tensed his arms, clenched his fists and went on to shout aggressively at the officers.
They then attempted to handcuff him but he continued to push and pull, trying to escape. After struggling to get his hand free he pushed one of the officers who fell backwards onto the tarmac and hit her head. She suffered a concussion and lower back pain which meant she was unable to work for two days following the incident.

Pengelley continued his prolonged struggle with the second officer who eventually used PAVA spray – similar to pepper spray – to stop the defendant.
Although Pengelley has a variety of other offences, none were thought to be directly relevant to the resisting arrest charge.
Judge Graeme McKerrell gave the defendant a two month suspended sentence as well as a £500 fine, which will be paid in compensation to the injured officer.
