An “error” in Jersey’s single-use plastics law will have to be corrected before the legislation can be used to ban single-use vapes, it has emerged.
The Single-Use Plastics etc. (Restrictions) (Jersey) Law 2021 was introduced to reduce the island’s use of avoidable single-use plastics and support Jersey’s carbon neutral policy.
Its powers are currently limited to single-use carrier bags, with politicians voting to bring single-use vapes under the scope of the law at the end of last year.
But it has now emerged that there is an “error” in the law where the “Royal Court” is referenced instead of the “Magistrate’s Court”.
This needs to be corrected before single-use vapes can be banned under this legislation, according to a proposition lodged today by the Infrastructure Minister.
Constable Andy Jehan urged politicians to support his amendment “so that the ban on single use vapes can be delivered”.
Single-use vapes are due to be banned in Jersey later this year, with full enforcement expected by mid-2025.
Express has asked the Government to confirm if the correction of this legislative error will delay the implementation of the ban.
