A 41-year-old man has been found guilty of sexually assaulting a woman and urinating on her – and taking pictures of the offences – but acquitted of rape.

Michael John O’Brien was convicted of sexual touching without consent, causing a sexual act without consent, sexual penetration without consent, and voyeurism following a four-day trial in the Royal Court.

On Thursday afternoon, a jury of six men and six women found him unanimously guilty of these charges but returned a not guilty verdict on the count of rape.

O’Brien took advantage of the woman while she was under the influence of alcohol and prescription drugs, the court heard.

During the trial, the prosecution said O’Brien used the victim’s vulnerable state as a “a unique opportunity to assault her”.

Detective Constable Emma Fewtrell, the officer in charge of investigating the offence, said: “The crimes committed against the victim are incomprehensible.

“This male took advantage of a vulnerable woman and abused her in the most appalling way. This is something the victim will have to live with for the rest of her life.

“I would like to offer my thanks to the victim in this case for coming forward to the police and for showing tremendous courage and bravery. Today justice was served.

“These crimes are the most heinous in our society and we remain committed to bring offenders to justice and along with our partner agencies remain dedicated to supporting victims of these crimes.”
