Investigation "ongoing" following seizure of products from CBD store

Tuesday 30 April 2024

A Customs investigation into CBD products that saw officers attend shops in Jersey and Guernsey earlier this year remains ongoing.

In February, Jersey Customs officers spoke to staff in the Bailiwick Botanicals shop in St Helier and took products away.

Around the same time, Bailiwick Law Enforcement confirmed that officers had also attended the company's Guernsey store and offered "words of advice" regarding a product, which it said followed action taken in Jersey "against a shop selling similar products".

Jersey Customs and Immigration Service (JCIS) said it related to "an ongoing investigation", with Bailiwick Botanicals later stating that Customs was undertaking "additional testing on a range of our products".

It was confirmed to Express this morning that the probe remains ongoing.

The CBD industry was shaken last year when a Home Office ruling led to the shutdown of Warwick Farm-based Jersey Hemp, after Whitehall civil servants decided that the Jersey firm's CBD products were illegal, which prevented them from being exported to the UK.

Jersey Hemp Director Craig Dempster claimed Jersey Hemp was told its product was banned because it contained THC, the main psychoactive ingredient in cannabis – even though the level had been proven to be within legal parameters – and criticised both the Jersey and UK governments for the "ridiculous" decision.

The case sent shockwaves through Britain’s £690 million cannabidiol industry, which launched an urgent ‘Save our CBD’ campaign amid fears over what the ruling could mean for the wider market.

However, after the island firm turned to the UK High Court to challenge the decision, the Home Office ultimately conceded that its ruling in relation to Jersey Hemp was not justified - something that drew criticism from Scottish National Party member Ronnie Cowan who took issue with how the company was treated.
