Detained teen "maliciously damaged" cell minutes before court appearance

A teenage boy caused significant damage to a cell as he waited to go into the Magistrate's Court for kicking and spitting at police officers and damaging a CCTV camera.

The young man – who can't be identified under the Children’s Law – was moments from taking to the stand to enter his pleas to four criminal counts when he lashed out in Cell No. 9.

The incident led to the teen’s Youth Court appearance being temporarily delayed while he was charged by officers with a fifth offence: “…Malicious damage… to a value yet to be ascertained and this to the prejudice of the States of Jersey.”

When he finally appeared before Relief Magistrate David Le Cornu, Advocate Heidi Heath indicated that he pleaded guilty to all charges.

These included an allegation that he and another male had maliciously damaged a Lloyds Bank CCTV camera on 21 October 2019.

On 14 November, the young man was arrested at the Parade. 

He was taken to Police headquarters and detained in a cell, where he fell asleep.

Later, Police woke the young man to tell him that he was going to be charged with malicious damage and then released.

According to Legal Adviser Susie Sharpe, prosecuting, the boy was “unhappy at being told that and being woken” and began to lash out at Police officers.

He kicked one officer in the groin, as well as spitting at him and another officer.

Having heard the facts of the young man’s offending, the Relief Magistrate ordered that a Social Enquiry Report into the young man’s background be prepared ahead of his sentencing.

Until his next court appearance on 3 December, the youth was also remanded in custody at Greenfields, a secure accommodation unit for children.
