Sex offender jailed for breaching restraining order

A 33-year-old man who was at “very high risk of sexual re-conviction” has been sentenced to two years in prison after breaching the restraining order which restricted his contact with girls under the age of 16.

33-year-old Sebastian Gasulla-Sole has a number of convictions that date between 1999 and 2018, including six counts of underage sexual intercourse with a minor, two counts of indecent assault and indecent exposure, as well as several motoring offences.

On 24 March, the defendant breached his restraining order by being in the company of a girl under the age of 16 without the presence of “an adult over the age of 21 who is aware of his offending history." On the same day, he purchased a 350ml bottle of vodka from Aquila Road Stores on behalf of someone under the age of 18.

He pleaded guilty to all six counts before his sentencing yesterday morning.

The Court also heard that Mr Gasulla-Sole had been sending inappropriate and suggestive messages to a 15-year-old girl where he complimented her appearance, discussed the use of drugs and attempted to arrange meeting her for dinner.

Mr Gasulla-Sole, who was defended by Advocate Luke Sette, was also charged with a series of motoring offences which related to driving a defective vehicle without registration or insurance.

Solicitor General Mark Temple suggested that the defendant serve a custodial sentence of two-and-a-half years as well as imposing enhanced orders restricting his contact with young girls. 

Defence Advocate Sette argued that since the defendant’s “greatest strength is co-operating with supervision”, a custodial sentence of 12 months, in combination with a long-standing probation order and community service, would be sufficient.

The Deputy Bailiff Tim Le Cocq QC, who was sitting with Jurats Rozanne Thomas and Pamela Pitman, imposed the enhanced orders, but decided “after some anxious consideration” that the Crown’s recommended sentence of two-and-a-half years was too long and handed down a sentence of two years.

Mr Gasulla-Sole was also placed on the Sex Offenders’ Register for a minimum of five years.

Handing down his sentence, the Deputy Bailiff said: “These restrictions were put in place to protect the vulnerable… In our view you deliberately disregarded the effect of the orders. 

“We express the wish that you take advantage of your time in prison with regard to your offending so that we do not see you back in Court.”
