Path wrath: neighbour suing over track access

Thursday 18 October 2018

Rowing neighbours are struggling to find the path to reconciliation as a dispute over a lane between their houses has escalated to legal action.

A St. Brelade resident is prepared to take her neighbours to the Royal Court, arguing that they have barred her entry to a footpath she’s supposed to have access to by installing locked gates at either end.

In documents submitted to the Royal Court, Olive Thomas claims that her neighbours Timothy and Rachael Huelin “are obliged to allow [her] a right of way on foot only… over the whole length of the roadway."

Mrs Thomas also accused the couple of allowing the path “to become overgrown with vegetation… rendering it impassable.”

In response, the Huelins say that they did install locked gates, but that they supplied Mrs Thomas with keys to ensure she can still use the pathway.

They deny that the path has become “overgrown” or rendered “impassable”, saying that “the vegetation has been cut back to allow the right of way to be exercised.”

The case continues.
