The question was raised yesterday in the trial of Jamie Lee Warn (55) as the jury continues deliberating his innocence or guilt regarding the alleged murder of Zsuzsanna Besenyei (37).

Mr Warn stands accused of murdering his former colleague, with whom he had a sexual relationship, and then lying to Police about it when they were investigating her death and disappearance – charges he denies. 

Miss Besenyei went missing in May of last year, days before her abandoned car was revealed by the outgoing tide at La Haule and, later, her body was discovered at Stinky Bay in L’Etacq. The prosecution claim that Mr Warn killed Miss Besenyei, hid her body in the boot of her own car and then disposed of her body on a beach at low tide.

The defence, however, claim that “truly vital questions… remain unanswered” by the prosecution’s case, meaning that the jury cannot be “sure” that Mr Warn had any part in the Hungarian national’s death.

The jury retired yesterday after hearing closing arguments from both the prosecution and defence, but they returned to the courtroom this morning to ask a question of the lawyers in this case. 

The jurors asked: “Can [intent to kill or cause serious bodily harm] be present as a ‘flashpoint’ or does premeditation have to be involved?”

Having consulted with lawyers from the prosecution – Crown Advocates Simon Thomas and Matthew Maletroit – and the defence – Advocate James Bell – the Deputy Bailiff Tim Le Cocq, presiding, responded to the six men and six women of the jury.

The Deputy Bailiff told the jury that “intention need not be premeditated, it could arise in the heat of the moment”, but he reminded them of their need to be “sure” that “the moment Mr Warn killed Miss Besenyei, if that is your finding, he intended to kill her or cause her serious bodily harm”.

The jury was then invited to retire again to consider their verdict.
